This concerns no. 3 roof terraces, two of which are on the second floor on the existing flat roof, specifically:
- Sub. 42 left side when looking at the building from the provincial road, approx. 1,900.00 sqm.
- Sub. 43 right side when looking at the building from the provincial road, approx. 1,800.00 sqm.
- Sub. 44 on the roof of the north tower and the south tower, approx. 1,350.00 sqm.
Conventional area: (1900.00 + 1800.00 + 1350.00) sqm = 5,050.00 sqm
On the flat roof described by sub. 43 there are the supermarket air-treatment machines; therefore, it is necessary to reduce the available surface area in order to allow proper protections and correct maintenance. The same requirement must also be acknowledged for the installation of the systems that will affect sub. 42.

Sub. 43 is accessed through a skylight identified in sub. 18
All skylights must be fitted with a suitable translucent structure, preventing infiltration of any kind, and equipped with a retractable ladder in compliance with the best safety practices. These requirements are currently missing and therefore must be implemented at the expense of the successful bidder.
As these are roof terraces covering the underlying premises, such surfaces are subject to all easements provided by law in condominium matters and are currently affected by the placement of machinery for the plant systems in general of the underlying premises, placed and to be placed along the perimeter strip and in correspondence with the same parapet.
Common property:
The multifunctional complex where the asset for sale is located is governed by condominium regulations that oversee the functionality and management of the entire complex for the use of the various units, the common areas, the galleries, the internal square with the fountain, all condominium-type roofs, all footprint areas also intended as green areas, the allocation of expenses, the protection of the decorum of the complex in its entirety and, in particular, also the management of any renewable energy systems that could complement the entire complex.
All parts of the complex are considered common parts when viewed in its architectural and civil-law unity, albeit with various intended uses, i.e., those indivisible parts and of common interest for the safeguarding, protection, integrity and preservation of the complex. These include:
- the land on which the various condominium buildings stand, the foundations, the load-bearing structure with the roof covering and anything else by destination and use of common interest pursuant to the current Civil Code;
- all areas of common interest referenced in the deeds of origin and in any case of general interest for the functions provided within the complex;
- the systems, the drainage networks with the various collection tanks up to the entrance of the individual properties;
- the various storage tanks provided in the basement for the recovery of wastewater and/or rainwater to be reused in the production cycle or limited to sanitary services only, as these are non-potable waters;
- the rising mains of electricity, water and the networks of common interest up to the entrance of the individual properties;
- all private roads serving the complex, including those in the basement level intended for garage premises;
- the decorum and image of the complex viewed in its architectural unity even if internally divided into exclusive properties.
The asset in question contributes to the maintenance of the common parts of the entire complex, specifically the condominium areas, the fire-prevention network, the technical water network, according to the respective thousandths share to be defined.
