It is specified that, with the inventories and the relative expert evaluations, any guarantees of any kind on the state of integrity and/or conformity and/or absence of faults/defects/anomalies in the movable assets identified and described in the same inventory listings.
The estimate of the quantities may be subject to a divergence which is summarily estimated with more than 10% of the total quantities and/or inventories documented. The effect of such plausible discrepancies must however be considered compensated with the application of the devaluation coefficients, used in the estimation to obtain the presumable "body" values of the inventory in question in consideration (therefore) also of the possible "differences" of consistency that are certainly present in correspondence with many articles/products involved.
The elements "loaded" and located at the warehouse in Ponte San Nicolò (PD) Via Europa were found to be, as far as detectable and apparent, largely made up of obsolete and/or disused components/products.
Furthermore :
a) The goods constituting the Warehouse will be transferred in the state of fact and law in which they will be found at the time of transfer; any differences in their consistency and/or quality cannot give rise to any compensation, indemnity or price reduction.
b) Any charge and cost of disassembly, recovery and transport of the goods, as well as any related liability, including for any damage to third parties and their property, will be borne entirely and exclusively by the transferee, who must do so no later than 30 days from 'award.
c) The subject identified as the best bidder will have the obligation to have the conformity of each asset belonging to the company checked and, if necessary, certified with the legal and regulatory provisions in force and, in particular, with the safety legislation, as well as to carry out any interventions necessary for this purpose, at its own expense.
