- The goods will be sold in the state of fact and law in which they are found, without any warranty, in the condition "as seen and liked" and as described in the report of Eng. Stefano Bertoglio. The announcement will provide adequate information on the non-compliance of the operating machines with the current Machinery Directive 2006/42/EC as, although some goods bear identification plates with the CE mark, it has not been possible to verify the correct functioning of the machinery, the integrity of the safety systems has not been verified, and the technical documentation (CE booklet, maintenance booklet, ENPI, etc.) has not been provided. Therefore, the burden lies with the successful bidder to verify the existence of the requirements for actual compliance with the current Machinery Directive 2006/42/EC as well as the existence of the requirements for prevention, safety and hygiene as well as environmental protection provided by the regulations in force at the time of sale, before putting into service or reselling the same on the market. Consequently, the Procedure assumes no responsibility regarding the functionality of the goods, their state of use and the absence of CE marking -
