Deposit

The present auction is subject to a deposit of  EUR 40.000,00.

Lots Availability
 
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on Procedure's expenses.

Property transfer

The transfer of ownership will take place only after full payment of the hammer price, expenses and Buyer's Premium by notarial deed with Notary with Studio in the Province of Trento chosen by the Mandator

Payment deadline
 
Awarded lots have to be paid in full within 60 days from the provisional awarding.

Buyer's premium due (plus VAT) has to be paid within 15 days from awarding.

Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full  within  60 days from the provisional awarding.


Buyer's Premium
 
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law). 
 
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
 
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.


VAT: 
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)


In case of insurgency of  any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website  translated in different languages, it will be applied the Italian language version of such texts

It should be noted that the assets are put up for sale in their entirety, considering that a preliminary contract of sale dated 04/05/2022 has been stipulated, duly transcribed, concerning the transfer in favor of the bankrupt company - already owner of the share of 1/2 - or to a third party to be named of the remaining share of the land, which will then be transferred after awarding.

The building land of 12,425 square meters falls within the building sector called C3.2 Lu Gialdinu and falls within sub-area C1.10 (art. 35 NTA Municipal Urban Plan of Santa Teresa Gallura) and in any case area subject to subdivision with building limits and restrictions- urban planning as deriving from the application of the reference standard to sub-area C1.10.

The Curator reserves the right to receive and evaluate offers of an amount less of the base price indicated above within the limit of 25%.
These offers will be evaluated only after the end of this auction at the unquestionable judgment of the Procedure Bodies, only in the absence of irrevocable offers for an amount equal to or greater than the base price.
In order to formulate an offer under the conditions described above, interested parties will NOT have to follow the "PERFECTION OF OFFERS AT AUCTION BASE PRICE" procedure referred to in the previous paragraph, but will be required to send a request to the pec address gorealbid@pec.it to find out how to submit and receive the relative offer form.
In any case, the irrevocable purchase offers presented on the basis of the aforementioned conditions will be subject to the application of the Buyer's Premium plus the statutory VAT, as indicated in the general and specific conditions and in the attached sale notice.
