Collection of lots won

The buyer may collect the lots won only after payment of the winning bid price and the applicable fees (Buyer's Premium and additional management charges) has actually been received.

In all cases, collection must be completed no later than 30 days after the provisional award.

To optimise the collection service, GOBID INTERNATIONAL AUCTION GROUP SRL will notify successful bidders by email of the date(s) and time slot during which they may collect the lots. These dates may also be indicated on the auction webpage. In all cases, GOBID INTERNATIONAL AUCTION GROUP SRL reserves the right to change the stated collection dates and times at its sole discretion.

If the successful bidder collects the lots on dates other than those communicated, they must pay an additional charge of between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of goods to be collected.

Successful bidders must comply with the date on which collection operations begin. If the successful bidder is unable to collect on the communicated date and at the communicated time, they may:

-  subject to approval, request permission to attend on the date(s) scheduled for the next sale, if applicable.

-  subject to approval, collect on days and at times other than those made available for that sale, paying an additional charge of between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of goods to be collected

Failure to comply with the collection date scheduled between GOBID INTERNATIONAL AUCTION GROUP SRL and the successful bidder will result in a penalty of EUR 350.00 being applied if the failure to collect is not notified at least 48 hours before the appointment, without prejudice, in all cases, to GOBID INTERNATIONAL AUCTION GROUP SRL's right to claim compensation for any greater damage suffered.

All lots not collected within the above deadline will be subject to a daily late fee of EUR 50.00. If the goods are not collected within 30 days of the collection deadline, the sale will automatically be deemed terminated, and the amounts paid by the successful bidder (for the lots won, Buyer's Premium, additional management charges and any additional fees paid) will be withheld as liquidated damages.

GOBID INTERNATIONAL AUCTION GROUP SRL is not required to deliver any lot or to arrange its collection in any way.

The buyer must carry out collection operations in compliance with the applicable statutory safety regulations; the buyer is therefore responsible for making any necessary arrangements to ensure such compliance, including with regard to any third parties and/or contractors engaged in carrying out those operations.

The buyer is responsible for any dismantling, handling, loading and transport of the lots won, and must leave the areas where collection takes place in a safe condition and free of any goods and/or waste materials generated during the above operations. For registered movable assets, the buyer is responsible for completing the procedures required to carry out the necessary transfers of ownership.

Transfers of ownership must therefore be carried out at the successful bidder's expense by the vehicle registration agency designated by the bodies administering the proceedings, or alternatively, by an agency designated by GOBID INTERNATIONAL AUCTION GROUP SRL.

If registered movable assets are exported, the buyer must carry out the required procedures in compliance with applicable law.

In all cases, GOBID INTERNATIONAL AUCTION GROUP SRL will not make any lot available until the above payments have been credited and, for registered movable assets, until the relevant transfer of ownership has been completed.

Other specific conditions

Buyer's Premium
: A charge of 15,00% + VAT will be added to the hammer price of each lot.

The Buyer’s Premium will be subject to a minimum amount of 25 € (+ VAT at 22% where applicable) for each lot or combination awarded, as a minimum commission.

Additional management charges: These are ancillary costs borne entirely by the successful bidder, intended to cover the services and activities, performed and to be performed, required for the preparation, organisation and management of the sale of the goods at auction and the subsequent award process. These expenses must be paid at the same time as the buyer's premium due, as stated in the provisional award confirmation, which will be issued after the auction has ended. Where applicable, these charges will be indicated in the description of each lot.

VAT: VAT at 22,00% of the sale price will be calculated on the hammer price of each lot (where applicable).
The procedure is not registered with VIES. VAT will therefore also be payable by intra-community buyers.

Extra-Time: if a winning bid is placed within the 5 minutes before the auction closes, the time available to place another bid will be extended by a further 5 minutes from the last bid received. This process will continue indefinitely: for every winning bid received within the 5-minute extra-time period, the time available to place another bid will be extended by a further 5 minutes from the last bid received.  Automatic bids in the event of a maximum bid (proxy bid) will also be considered winning bids.

Lots are sold as seen and approved, in their current condition. Inspection is recommended.

Any modifications required to bring the goods into compliance with all applicable regulations, and in particular those concerning accident prevention and safety, as well as environmental protection and, more generally, applicable regulations, shall be the buyer's sole responsibility. The buyer shall bear all related expenses, and the transferor shall be released from any liability in this regard. Any equipment that does not comply with the regulations currently in force, if included in the inventory, shall be considered as sold solely for use as spare parts, and the Receivership shall bear no liability if the transferee uses such equipment. In particular, with regard to any goods that do not comply with safety regulations and lack the CE mark, the successful bidder is required, at their sole care, expense and risk, to bring them into compliance or, if this is not possible, to dispose of them in accordance with the law.

The sale of the goods is a forced sale (Art. 2919 of the Italian Civil Code); the goods are sold as seen and approved, in their factual and legal condition as they stand. In a forced sale, there is no warranty for defects in the goods. The sale may not be challenged on grounds of damage (Art. 2922 of the Italian Civil Code).

Accordingly, the existence of any defects, lack of quality or discrepancies in the goods sold shall not give rise to any compensation, indemnity or price reduction.

The Agent shall have no liability whatsoever with regard to the existence of third-party rights over the goods being sold (Art. 2920 of the Italian Civil Code).

The sale is subject to the successful bidder's obligation and responsibility to verify that the goods comply with safety regulations.

In the event of any disputes concerning the interpretation of the provisions contained in the general and specific conditions set out on the platform, which may have been translated into other languages, the Italian version of the text shall prevail.
