By submitting the bid, the bidder declares that they have fully reviewed and fully accept these conditions of sale and all documentation made available. If there is a sale notice attached to the auction sheet/listing, by submitting the bid, the bidder declares that they have reviewed and accept the conditions set out therein, with respect to which these conditions of sale are to be understood as an extract. The bidder further declares that they have examined and accepted all documentation made available for the purposes of participation

Deposit

The auction is subject to a security deposit in the amount of EUR 1.000,00.

The deposit must be paid via:

The deposit must be credited strictly before the auction end.
Once the deposit has been credited, the user will be enabled to participate in the auction.
To speed up participation in the auction, the user is advised to send a scanned accounting copy of the payment made with the CRO code to: [email protected]

If the auction participants do not win any lot, the deposit will be refunded within 20 working days from the final auction end, without interest.

If, in the event of a successful bid, after paying the deposit, the bidder does not complete the purchase, such deposit will be retained.

Awarding of Lots



Availability of Lots

Any registrations relating to rights of preemption, transcriptions of foreclosures and conservatory seizures and any other encumbrance on the assets put up for sale, will be cancelled pursuant to art. 217, paragraph 2° C.C.I.I. once the sale has been carried out and the price fully collected. All formalities for cancellation shall be carried out by the successful bidder at their own care and expense.

Any cost relating to transfers of ownership, including any double transfers and related charges, shall be borne by the successful bidder

In the event of export of registered movable assets, the buyer must carry out the required operations in compliance with current regulations. Please note that for the purposes of deregistration for export, on the date of the request, the vehicles must be in compliance with the mandatory periodic inspection obligations established by law.

Payment method

All payments must be made exclusively by bank transfer. The details will be specified either at the time of registration or upon receipt by the user of the award notice (see general conditions).

Payment deadline

The awarded lots must be paid within 5 days from confirmation of provisional award.
The Buyer's Premium and ancillary management charges, where applicable, must be paid within 5 days from confirmation of provisional award.

Collection of awarded lots
 
Collection of the awarded lots by the buyer may take place only after actual receipt of payment of the award price and the commissions provided for (Buyer’s Premium, ancillary management charges).
 
In any case, collection must be completed within and no later than 30 days from the provisional award.
 
In order to optimize the collection service, GOBID INTERNATIONAL AUCTION GROUP SRL will notify the successful bidders by e-mail of the date(s) and a time during which they may proceed with collection of the lots.  Such dates may also be indicated on the auction web page. GOBID INTERNATIONAL AUCTION GROUP SRL in any case reserves the right to change the indicated collection dates and times at its sole discretion.
 
If the successful bidder collects on dates other than those communicated, they must pay a fee between EUR 250.00 and EUR 350.00 plus VAT  per day, depending on the quantity of goods to be collected, as additional charges.
 
The successful bidders shall be required to comply with the start date of operations. If the successful bidder cannot collect on the communicated day and time, they may:
 
-  subject to approval, request to be admitted during the date(s) scheduled for the subsequent sale attempt, if any.
 
-  subject to approval, collect on days and at times other than those made available for the individual sale attempt, paying an additional fee between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of goods to be collected, as additional charges
 
Failure to comply with the  collection date scheduled between GOBID INTERNATIONAL AUCTION GROUP SRL and the successful bidder shall result in the application to the latter of a penalty of EUR 350.00 if the failure to collect is not notified at least 48 hours before the appointment, without prejudice, in any case, to compensation for the greater damage suffered by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
All lots not collected within the above-indicated deadline shall be subject to a daily late fee of EUR 50.00. If the asset is not collected within 30 days from the collection deadline, the sale shall be automatically deemed terminated and the amounts paid by the successful bidder (Awarded Lots - Buyer’s Premium, ancillary management charges and any additional charges paid) shall be retained as liquidated damages. 
 
GOBID INTERNATIONAL AUCTION GROUP SRL is not required to deliver any lot nor to organize in any way their collection. 
 
Collection operations must be carried out by the buyer in compliance with current safety regulations established by law; the buyer shall therefore be required to make the necessary adjustments in this regard also with reference to any third parties and/or collaborators employed in carrying out such operations.
 
The buyer is responsible for any disassembly, handling, loading and transport of the awarded lots and is required to leave the places involved in the collection in safe conditions and free of goods and/or waste materials produced by them during the above-mentioned operations. In the case of registered movable assets, the buyer shall be deemed responsible for handling the paperwork required to carry out the necessary transfers of ownership. 
 
The transfers of ownership must therefore be carried out by the successful bidder at their own care and expense at the motor vehicle registration agency communicated by the Procedure Bodies, or alternatively, communicated by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
In the event of export of registered movable assets, the buyer must carry out the required operations in compliance with current regulations.
 
In any case, GOBID INTERNATIONAL AUCTION GROUP SRL will not make any lot available before the above-mentioned payments have been credited and, in the case of registered movable assets, before completion of the relevant transfer of ownership.
Other specific conditions

Buyer's Premium: A charge of 10,00% + VAT will be added to the hammer price of each lot.

The Buyer’s Premium will have a minimum amount of €25 (+ VAT at 22% where applicable), on each of the lots or combinations awarded, as minimum fees.

Additional management charges: They are additional costs borne entirely by the successful bidder, intended to cover the services and activities, performed and to be performed, necessary for the preparation, organization and management of the sale of goods at auction and the subsequent award phase. Such expenses must be paid at the same time as the payment of the buyer's premium due as per the provisional award confirmation that will be issued after the end of the auction. Where due, such charges will be indicated in the sheet of each lot.

VAT: VAT at 22,00% of the sale price will be calculated on the hammer price of each lot. (where applicable)
The procedure is not registered with VIES. VAT will therefore also be due for intra-Community buyers.

Extra-Time: if a winning bid is placed in the 5 minutes preceding the closing of the auction, the time available to make another bid will be extended by a further 5 minutes from the last bid received. And so on, for each winning bid received within the 5 minutes of extra time, the time available to make another bid will be extended by a further 5 minutes from the last bid received.  Automatic rebids in the case of a maximum bid (proxy bid) will also be considered  winning bids.

The lots are sold as seen and approved in the state in which they are found. Viewing is recommended.

Any adjustments of the goods to all applicable regulations and in particular to those on prevention, safety as well as those concerning ecological and environmental protection and – more generally – to applicable regulations shall be the exclusive responsibility of the buyer, who shall bear any expense, with the seller released from any liability in this regard. Any equipment not complying with regulations currently in force on the matter, if included in the inventory, will be considered subject to sale solely as goods to be used as spare parts, with exclusion of any liability of the Receivership for the event of their use by the assignee. In particular, for any goods not compliant with safety regulations, lacking the CE mark, the successful bidder is obliged to proceed, at its sole care, expense and risk, to bring them into compliance or, if this is not possible, to dispose of them in the forms required by law.

The sale of the goods is understood to be forced (Art. 2919 Italian Civil Code) and is arranged for the goods as seen and approved in the factual and legal state in which they are found. In a forced sale, the warranty for defects of the thing does not apply. It cannot be challenged on grounds of damages. (Art. 2922 Italian Civil Code).

Consequently, the existence of any defects or lack of quality or non-conformity of the thing sold may not give rise to compensation, indemnity or reduction of the price.

Any liability on the part of the Agent is excluded with regard to the existence of third-party rights over the goods subject to sale (Art. 2920 Italian Civil Code).

The sale takes place with the obligation and burden on the successful bidder to verify their compliance with safety regulations.

In the event of any disputes arising regarding the interpretation of the provisions contained in the general and specific conditions reported on the platform, possibly translated into other languages, the Italian version of the text shall prevail.
