By submitting the bid, the bidder declares to have fully reviewed and to fully accept these conditions of sale and all documentation made available. If a sale notice is attached to the auction sheet/listing, by submitting the bid, the bidder declares to have reviewed and to accept the conditions set out therein, with respect to which these conditions of sale are to be understood as an extract. The bidder further declares to have examined and accepted all documentation made available for participation

Deposit

The auction is subject to a security deposit of EUR 500,00.

Lot 0 requires payment of a deposit equal to EUR 3.300,00

Lots with a starting value equal to or greater than EUR 5,000.00 require payment of a specific security deposit indicated in the relevant lot sheets.

The deposit must be credited mandatorily before the auction end.
Once the deposit has been credited, the user will be enabled to participate in the auction.
To speed up participation in the auction, the user is advised to send a scanned accounting copy of the payment made with the CRO code to: [email protected]

If the auction participants do not win any asset, the deposit will be returned within 20 working days from the final auction end, without interest.

If, in the event of award, after paying the deposit, the bidder does not complete the purchase, such deposit will be withheld.

Availability of Lots

Any registrations relating to rights of first refusal, transcriptions of foreclosures and conservatory seizures and any other encumbrance on the assets sold, will be cancelled pursuant to art. 217, paragraph 2 C.C.I.I. once the sale is executed and the price fully collected. Any formality for cancellation will be carried out at the care and expense of the successful bidder.

Any cost relating to transfers of ownership, including any double transfers and related charges, will be borne by the successful bidder

In the case of export of registered movable assets, the buyer must carry out the required operations in compliance with current regulations. Please note that for the purposes of deregistration for export, at the date of request, the vehicles must be in compliance with the periodic inspection obligations required by law.

Payment method

All payments must be made exclusively by bank transfer. The details will be specified either at the time of registration or upon the user's receipt of the award communication (see general conditions).

Payment deadline

Awarded lots must be paid within 5 days from the provisional award confirmation.
The Buyer's Premium and ancillary management charges, where provided, must be paid within 5 days from the provisional award confirmation.

Collection of awarded lots
 
Collection of the awarded lots by the buyer may take place only after actual receipt of payments of the award price and the applicable commissions (Buyer’s Premium, ancillary management charges).
 
In any case, collection must be completed within and no later than 30 days from the provisional award.
 
In order to optimize the collection service, GOBID INTERNATIONAL AUCTION GROUP SRL will communicate by e-mail to the successful bidders the date(s) and a time during which they may proceed with collection of the lots.  Such dates may also be indicated on the auction web page. GOBID INTERNATIONAL AUCTION GROUP SRL reserves in any case the right to change the indicated collection dates and times at its sole discretion.
 
If the successful bidder collects on dates other than those communicated, the same must pay a fee between EUR 250.00 and EUR 350.00 plus VAT  per day, depending on the amount of goods to be collected, as additional charges.
 
Successful bidders will be required to comply with the start date of operations. If the successful bidder cannot collect on the communicated day and time, the same may:
 
-  subject to approval, request to be admitted during the date(s) scheduled for the next sale attempt, if any.
 
-  subject to approval, collect on days and times other than those made available for the individual attempt, paying an additional fee between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the amount of goods to be collected, as additional charges
 
Failure to comply with  the collection date scheduled between GOBID INTERNATIONAL AUCTION GROUP SRL and the successful bidder will result in the application to the latter of a penalty of EUR 350.00 if the failure to collect is not notified at least 48 hours before the appointment, without prejudice, in any case, to compensation for greater damage suffered by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
All lots not collected within the above deadline will be subject to a daily late fee of EUR 50.00. In the event that the asset is not collected within 30 days from the collection deadline, the sale will be automatically terminated and the amounts paid by the successful bidder (Awarded Lots - Buyer’s Premium, ancillary management charges and any additional charges paid) will be withheld as a compensatory penalty. 
 
GOBID INTERNATIONAL AUCTION GROUP SRL is not required to deliver any lot nor to organize in any way their collection. 
 
Collection operations must be carried out by the buyer in compliance with current safety regulations imposed by law; the same will therefore be required to make the necessary adjustments in this regard also with reference to any third parties and/or collaborators employed in carrying out said operations.
 
The buyer is responsible for any disassembly, handling, loading and transport of the awarded lots and is required to leave the places affected by collection in safe conditions and free of goods and/or residual materials produced by him during the above operations. In the case of registered movable assets, the buyer is understood to be responsible for handling the practices required to carry out the necessary transfers of ownership. 
 
Transfers of ownership must therefore be carried out at the care and expense of the successful bidder at the vehicle registration agency communicated by the Procedure Bodies, or alternatively, communicated by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
In the case of export of registered movable assets, the buyer must carry out the required operations in compliance with current regulations.
 
In any case, GOBID INTERNATIONAL AUCTION GROUP SRL will not make available any lot before the above payments have been credited and, in the case of registered movable assets, before completion of the relevant transfer of property.

Lot 38 - 39 - 40: The quantities indicated may be subject to a variation of +/- 5% 
Other specific conditions

Buyer's Premium: A charge of 10,00% + VAT will be added to the hammer price of each lot.

The Buyer’s Premium will have a minimum amount of 25 € (+ 22% VAT where applicable), on each of the lots or combinations awarded, as minimum commissions.

Ancillary management charges: They are ancillary costs borne entirely by the winning bidder, intended to cover the services and activities, performed and to be performed, necessary for the preparation, organisation and management of the sale of the goods at auction and the subsequent award phase. These expenses must be paid at the same time as the payment of the buyer's premium due, as per the provisional award confirmation that will be issued after the end of the auction. Where due, such charges will be indicated in the details page of each lot.

VAT: VAT at 22,00% of the sale price will be calculated on the hammer price of each lot. (where applicable)

Extra-Time: if a winning bid is placed within 5 minutes before the close of the auction, the time available to place another bid will be extended by an additional 5 minutes from the last bid received. And so on, for each winning bid received within 5 minutes of extra time, the time available to place another bid will be extended by an additional 5 minutes from the last bid received.  Automatic bids in the case of a maximum bid (proxy bid) will also be considered winning bids.

Bids on the Complete Lot: If no bid is received for the complete lot (Lot 0), the individual lots and/or combinations will be awarded.
If bids are received for the complete lot (Lot 0), the bodies of the Procedure, at the end of the auction, reserve the right to award or not award this lot based on the values achieved by the individual lots.

The lots are sold as seen and approved in the condition in which they are found. Viewing is recommended.

Any adjustments of the goods to all applicable regulations and in particular to those on prevention and safety, as well as those concerning ecological and environmental protection and – more generally – to applicable regulations, shall be the exclusive responsibility of the buyer, who shall bear any expense, with the seller released from any liability in this regard. Any equipment not complying with the regulations currently in force on the matter, where included in the inventory, will be considered as subject to the sale solely as goods to be used as spare parts, with the exclusion of any liability of the Receivership for the event of their use by the assignee. In particular, for any goods not complying with safety regulations, without CE marking, the winning bidder is required to proceed, at their exclusive care, expense and risk, to bring them into compliance or, if this is not possible, to dispose of them in the forms provided by law.

The sale of the goods is understood as forced (Art. 2919 of the Italian Civil Code) and is arranged for the goods sold as seen and approved in the factual and legal state in which they are found. In a forced sale, the warranty for defects of the item does not apply. It cannot be challenged on grounds of damages. (Art. 2922 of the Italian Civil Code.).

Consequently, the existence of any defects or lack of quality or non-conformity of the item sold may not give rise to compensation, indemnity or reduction of the price.

Any liability on the part of the Agent regarding the existence of third-party rights over the goods subject to the sale is excluded (Art. 2920 of the Italian Civil Code).

The sale takes place with the obligation and burden on the winning bidder to verify their compliance with safety regulations.

In the event of any disputes arising regarding the interpretation of the provisions contained in the general and specific conditions set out on the platform, possibly translated into other languages, the Italian version of the text shall prevail.
