By submitting the bid, the bidder declares to have fully reviewed and to fully accept these terms of sale and all documentation made available. The deposit must be credited no later than the auction end. Once the deposit has been credited, the user will be enabled to participate in the auction.
To speed up participation in the auction, the user is advised to send a scanned accounting copy of the payment made with the CRO code to:
[email protected]If auction participants do not win any asset, the deposit will be returned within 20 working days from the final auction deadline, without interest.
If, in the event of successful bidding, after paying the deposit, the bidder does not complete the purchase, such deposit will be retained.
Availability of Lots
Any cost relating to ownership transfers, including any double transfers and related charges, shall be borne by the successful bidderPayment methodAll payments must be made exclusively by bank transfer. The details will be specified either at the time of registration or upon receipt by the user of the award communication (see general conditions).
Payment deadlineThe awarded lots must be paid within
5 days from confirmation of provisional award.
The Buyer's Premium and ancillary management charges, where provided, must be paid within
5 days from confirmation of provisional award.

Collection of awarded lots Collection of the awarded lots by the buyer may take place only after actual receipt of payment of the award price and the required commissions (Buyer's Premium, ancillary management charges).
In any case, collection must be completed
within and no later than 30 days from the provisional award.
In order to optimize the collection service, GOBID INTERNATIONAL AUCTION GROUP SRL will notify the successful bidders by e-mail of the date(s) and a time during which they may proceed with collection of the lots. Such dates may also be indicated on the auction web page. GOBID INTERNATIONAL AUCTION GROUP SRL in any case reserves the right to change the collection dates and times indicated at its sole discretion.
If the successful bidder should collect on dates other than those communicated, they must pay a fee of between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the volume of the assets to be collected, as additional charges.
Successful bidders shall be required to comply with the start date of operations. If the successful bidder cannot collect on the communicated day and time, they may:
- subject to approval, request to be admitted during the date(s) scheduled for the subsequent sale attempt, if any.
- subject to approval, collect on days and at times other than those made available for the individual sale attempt, paying an additional fee of between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the volume of the assets to be collected, as additional charges
Failure to comply with the scheduled collection date between GOBID INTERNATIONAL AUCTION GROUP SRL and the successful bidder will result in the application to the latter of a penalty of EUR 350.00 if the failure to collect is not notified at least 48 hours before the appointment, without prejudice, in any case, to compensation for the greater damage suffered by GOBID INTERNATIONAL AUCTION GROUP SRL.
All lots not collected within the above deadline will be subject to a daily late fee of EUR 50.00. If the asset is not collected within 30 days from the collection deadline, the sale shall be automatically terminated and the amounts paid by the successful bidder (Awarded Lots - Buyer's Premium, ancillary management charges and any additional charges paid) will be retained as a liquidated damages penalty.
GOBID INTERNATIONAL AUCTION GROUP SRL is not required to deliver any lot nor to organize in any way their collection.
Collection operations must be carried out by the buyer in compliance with the applicable safety regulations established by law; the buyer shall therefore be required to make the necessary adjustments in this regard also with reference to any third parties and/or collaborators employed in carrying out the aforementioned operations.
The
buyer is responsible for any
dismantling, handling, loading and transport of the awarded lots and is required to leave the places involved in the collection in safe conditions and free of goods and/
or waste materials produced by them during the aforementioned operations. In the case of registered movable assets, the
buyer shall be understood as responsible for handling the paperwork required to carry out the necessary ownership transfers.
Ownership transfers must therefore be carried out at the care and expense of the successful bidder at the vehicle registration agency communicated by the Procedure Bodies, or alternatively, communicated by GOBID INTERNATIONAL AUCTION GROUP SRL.
In the case of export of registered movable assets, the buyer must carry out the required operations in compliance with applicable regulations.
In any case, GOBID INTERNATIONAL AUCTION GROUP SRL will not make any lot available before the above payments have been credited and, in the case of registered movable assets, before completion of the relevant ownership transfer.
Other specific conditions
Buyer's Premium: A charge of 12,00% + VAT will be added to the hammer price of each lot.
The Buyer's Premium will have a minimum amount of 25 € (+ 22% VAT where applicable), on each lot or combination awarded, as minimum fees.
Ancillary management charges: These are ancillary costs charged entirely to the successful bidder, intended to cover the services and activities, performed and to be performed, necessary for the preparation, organization and management of the sale of auction goods and the subsequent award phase. Such expenses must be paid at the same time as payment of the buyer's premium due as per the provisional award confirmation that will be issued after the end of the auction. Where due, such charges will be indicated in the page of each lot.
VAT: VAT at 22,00% of the sale price will be calculated on the hammer price of each lot. (where applicable)
The procedure is not registered with VIES. VAT will therefore be due also for intra-EU buyers.Extra-Time: if a winning bid is placed within the 5 minutes preceding the closing of the auction, the time available to place another bid will be extended by a further 5 minutes from the last bid received. And so on, for each winning bid received within the 5 minutes of extra time, the time available to place another bid will be extended by a further 5 minutes from the last bid received.
Automatic bids in the case of a maximum offer (proxy bid) will also be considered winning bids.Lots are sold as seen and liked in the state in which they are found. Viewing is recommended.The sale of the goods is understood as forced (Art. 2919 Italian Civil Code) and is ordered for goods seen and liked in the factual and legal state in which they are found. In a forced sale, the warranty for defects of the thing does not apply. It cannot be contested on grounds of damages. (Art. 2922 Italian Civil Code).Consequently, the existence of any defects or lack of quality or non-conformity of the goods sold cannot give rise to compensation, indemnity or reduction of the price.Any liability on the part of the Agent is excluded with regard to the existence of third-party rights over the goods subject to the sale (Art. 2920 Italian Civil Code).The sale occurs with the obligation and burden on the successful bidder to verify their compliance with safety regulations.In the event of any disputes relating to the interpretation of the provisions contained in the general and specific conditions shown on the platform, possibly translated into other languages, the Italian version of the text shall prevail.
