By submitting a bid, the bidder declares to have fully reviewed and to fully accept these conditions of sale and all documentation made available. If a sale notice is attached to the auction sheet/announcement, by submitting the bid, the bidder declares to have reviewed and to accept the conditions set out therein, with respect to which these conditions of sale are to be understood as an extract. The bidder further declares to have examined and accepted all documentation made available for the purposes of participation

Deposit

The auction is subject to a security deposit of EUR 400,00.

Lot 0 requires the payment of a deposit equal to EUR 1.500,00

The deposit must be credited before the auction end.
Once the deposit is credited, the user will be enabled to participate in the auction.
To speed up participation in the auction, the user is advised to send a scanned accounting copy of the payment made with the CRO code to: [email protected]

If the auction participants do not win any asset, the deposit will be returned within 20 working days from the final auction end, without interest.

If, in the event of a successful bid, after paying the deposit, the bidder does not complete the purchase, said deposit will be retained.

Availability of Lots

Any registrations relating to pre-emption rights, registrations of foreclosures and conservatory seizures and any other encumbrance on the assets put up for sale will be cancelled once the sale is completed and the price is fully collected. Any formalities for cancellation will be carried out at the expense of the successful bidder.

Any cost relating to transfers of ownership, including any double transfers and related charges, will be borne by the successful bidder

In the case of export of registered movable assets, the buyer must carry out the required operations in compliance with applicable regulations. Please note that for the purposes of deregistration for export, at the date of the request, the vehicles must be in compliance with the periodic inspection obligations required by law.

Payment method

All payments must be made exclusively by bank transfer. The details will be specified either at the time of registration or upon the user's receipt of the successful bid communication (see general conditions).

Payment deadline

The awarded lots must be paid within 5 days from the provisional award confirmation.
The Buyer's Premium and ancillary management charges, where provided, must be paid within 5 days from the provisional award confirmation.

Collection of awarded lots

Collection of the awarded lots by the buyer may take place only after actual receipt of payment of the award price and the fees provided (Buyer’s Premium, ancillary management charges).

In any case, collection must be completed within and no later than 30 days from the provisional award.

In order to optimize the collection service, GOBID INTERNATIONAL AUCTION GROUP SRL will notify the successful bidders by e-mail of the date(s) and a time during which they may proceed with collection of the lots. Such dates may also be indicated on the auction web page. GOBID INTERNATIONAL AUCTION GROUP SRL in any case reserves the right to change the indicated collection dates and times at its sole discretion.

If the successful bidder should collect on dates other than those communicated, they must pay a fee between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of goods to be collected, as additional charges.

Successful bidders will be required to comply with the start date of operations. If the successful bidder cannot collect on the communicated day and time, they may:

- upon approval, request to be admitted during the date(s) scheduled for the subsequent sale attempt, if any.

- upon approval, collect on days and times other than those made available for the individual sale attempt, paying an additional fee between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of goods to be collected, as additional charges

Failure to comply with the scheduled collection date between GOBID INTERNATIONAL AUCTION GROUP SRL and the successful bidder will result in the application to the latter of a penalty of EUR 350.00 if the failure to collect is not notified at least 48 hours before the appointment, without prejudice, in any case, to compensation for greater damage suffered by GOBID INTERNATIONAL AUCTION GROUP SRL.

All lots not collected within the above deadline will be subject to a daily penalty of EUR 50.00. If the asset is not collected within 30 days from the collection deadline, the sale will be deemed automatically terminated and the amounts paid by the successful bidder (Awarded Lots - Buyer’s Premium, ancillary management charges and any additional charges paid) will be retained as a compensatory penalty.

GOBID INTERNATIONAL AUCTION GROUP SRL is not required to deliver any lot nor to organize in any way their collection.

Collection operations must be carried out by the buyer in compliance with current safety regulations established by law; the buyer will therefore be required to make the necessary adaptations in this regard, also with reference to any third parties and/or collaborators used in carrying out said operations.

The buyer is responsible for any disassembly, handling, loading and transport of the awarded lots and is required to leave the places affected by collection in safe conditions and free from goods and/or residual materials produced by them during the above operations. In the case of registered movable assets, the buyer is understood to be responsible for completing the procedures necessary to carry out the required transfers of ownership.

Transfers of ownership must therefore be carried out at the expense of the successful bidder at the motor vehicle registration agency communicated by the Procedure Bodies, or alternatively, communicated by GOBID INTERNATIONAL AUCTION GROUP SRL.

In the case of export of registered movable assets, the buyer must carry out the required operations in compliance with applicable regulations.

In any case, GOBID INTERNATIONAL AUCTION GROUP SRL will not make any lot available before the above payments have been credited and, in the case of registered movable assets, before completion of the relevant transfer of ownership.

Other specific conditions

Buyer's Premium: A charge of 10,00% + VAT will be added to the award price of each lot.

The Buyer’s Premium will have a minimum amount of EUR 25 (+ 22% VAT where applicable), on each of the awarded lots or combinations, as minimum fees.

Ancillary management charges: These are ancillary costs borne entirely by the successful bidder, intended to cover the services and activities, performed and to be performed, necessary for the preparation, organization and management of the sale of the auction goods and subsequent award phase. Such expenses must be paid together with the payment of the buyer's premium due as per the provisional award confirmation that will be issued after the auction end. Where due, such charges will be indicated in the sheet of each lot.

VAT: VAT at 22,00% of the sale price will be calculated on the award price of each lot. (where applicable)
The procedure is not registered for VIES. VAT will therefore also be due for intra-Community buyers.

Extra-Time: if a winning bid is placed within the 5 minutes preceding the auction closing, the time available to place another bid will be extended by an additional 5 minutes from the last bid received. And so on, for each winning bid received within the 5 minutes of extra time, the time available to place another bid will be extended by a further 5 minutes from the last bid received. Automatic bids in the case of a maximum bid (proxy bid) will also be considered winning bids.

Bids on the Complete Lot: If no bid has been received on the complete lot (Lot 0), the individual lots and/or combinations will be awarded.
If bids are received on the complete lot (Lot 0), the Procedure Bodies at the end of the auction reserve the right to award or not award this lot based on the values reached by the individual lots.

The lots are sold as seen and liked in the condition in which they are found. Viewing is recommended.

The sale of the goods is deemed forced (Art. 2919 Italian Civil Code) and is arranged for goods seen and liked in the factual and legal condition in which they are found. In a forced sale, the warranty for defects of the thing does not apply. It cannot be challenged on grounds of damages. (Art. 2922 Italian Civil Code).

Consequently, the existence of any defects or lack of quality or non-conformity of the thing sold may not give rise to compensation, indemnity or price reduction.

Any liability on the part of the Mandatary regarding the existence of third-party rights over the goods subject to sale is excluded (Art. 2920 Italian Civil Code).

The sale takes place with the obligation on the part and at the expense of the successful bidder to verify their compliance with safety regulations.

In the event of any disputes relating to the interpretation of the provisions contained in the general and specific conditions set out on the platform, possibly translated into other languages, the Italian version of the text shall prevail.
