Deposit

To participate in the Auction, it is necessary to pay a security deposit of EUR 1.600,00.

Lots with an estimated value equal to or greater than EUR 2,000.00 require the payment of a specific deposit indicated in the corresponding lot sheets. The payment of the deposit for a specific lot also unlocks eligibility for individual lots with a general security deposit (basic deposit).

Lot 0 requires a deposit of EUR 22.350,00.

The deposit must be made by bank transfer to the account set out below:

Reference: (auction number and lot number)

The deposit must be paid before the end of the Auction.

Only once the deposit has been received will the user be authorized to participate in the Auction.
To speed up participation in the auction, it is recommended to send the proof of payment to [email protected].

Users who have participated in the Auction but have not been awarded any asset will receive their deposit back within 20 business days from the conclusion of the auction, without interest.

If participants are awarded one or more lots, the deposit paid will be refunded once the removal of all acquired lots has been completed, with prior authorization from the AC, within a maximum of 5 business days from the end.

If, after having paid the deposit and having been awarded the lot for sale, the bidder does not complete the acquisition by paying the sale price and the Buyer's Premium, said deposit will be retained.

Encumbrances

The sale of the assets is made free of encumbrances and charges.

However, all taxes, levies, and duties legally applicable relating to the award or sale or transfer of each asset shall be for the account of and borne by the awardees or buyers. If the vehicles have unpaid municipal taxes IVTM, these shall be borne by the awardee.

Award of the lots

At the end of the auction, if the winning bid of the auction is equal to or higher than the reserve price, an award confirmation will be sent to the highest bidder with instructions to make the payments within the established deadlines.

If the bid does not reach the minimum or reserve price, the award must be approved by the Insolvency Administration.

Warning: the Insolvency Administration reserves the right to communicate the winning bid to the Court for its approval. In this case, only once the bid has been approved by the Court, an award confirmation will be sent to the highest bidder with instructions to make the payments within the established deadlines.

Payment method

All payments must be made entirely by bank transfer using the accounts communicated at the time of registration or together with the award communication (see general auction conditions).

Payment deadline

The payment of the award price of the lots must be made within 10 days from the award communication.

The payment of the Buyer's Premium must be made within 10 days from the award communication.

Conditions for removal

In any case, removal must be completed no later than 20 days from the provisional award confirmation.

In order to optimize the collection service, GOBID ESPAÑA S.L will notify the successful bidders by email of the date and time to proceed with the collection of the lots. These dates may also be indicated on the auction website. In any case, GOBID ESPAÑA S.L reserves the right to change the dates and times indicated for collection at its sole discretion.

If the successful bidder has to carry out the collection on dates additional to those offered, they must pay an amount between EUR 250.00 and EUR 350.00 plus VAT for each added day, depending on the goods to be collected, as additional expenses.

The successful bidders must respect the proposed date. If they cannot carry out the collection on the communicated date and time, they may:

- with prior approval, request that collection be allowed during the following experiment, if scheduled.

- with prior approval, carry out the collection on days and times other than those initially proposed in the same sale phase, paying a further fee of between EUR 250.00 and EUR 350.00 plus VAT per added day and person required for assistance, as additional expenses.

Failure to comply with the collection date scheduled between GOBID ESPAÑA S.L and the successful bidder will result in the application of a penalty to the latter of EUR 350.00 if they have not notified cancellation of the collection at least 48 hours before the appointment, without prejudice to the fact that, in any case, compensation for damages to GOBID ESPAÑA S.L must be paid.

Lots that have not been collected within the established period will be subject to a daily penalty of EUR 100.00. If the good is not collected within 15 days following the last day scheduled for collection, the sale will be considered terminated and the amounts paid by the successful bidder (Awarded lots – Buyer’s Premium, complementary management expenses and any additional charges paid) will be retained as compensation for the damage caused.

GOBID ESPAÑA S.L has no obligation to deliver any lot or to organize in any way the collection and delivery thereof.

Collection operations must be carried out by the buyer in compliance with the safety regulations in force established by law; therefore, they will be obliged to make the necessary adjustments even when it refers to third parties and/or collaborators employed in carrying out the aforementioned operations.

The successful bidder is responsible for any dismantling, moving, loading and transport of the awarded lots and, in the case of vehicles, also for the transfer of ownership and other corresponding procedures.

In any case, GOBID ESPAÑA S.L will not make any lot available before the previous payments have been paid and, in the case of registered movable goods, before the corresponding transfer of ownership is completed.

Formalization and collection of the goods:

The successful bidder will be obliged to formalize the corresponding purchase and sale contract within the period indicated by the auction management entity. Likewise, they must carry out, at their own expense and responsibility, all procedures necessary for the change of ownership of the awarded good before the Directorate-General for Traffic (DGT) and any other public registries that may apply.

If the collection of the good takes place prior to the change of ownership, the successful bidder will assume from that moment all responsibilities, charges, expenses, taxes and penalties that may arise from it, expressly releasing the seller entity and the management entity from any liability after delivery.

Other specific conditions

Buyer’s Premium: a charge of 10,00% (plus 21% VAT, if applicable) of the award price of each lot, which will be added to it.

The Buyer’s Premium will have a minimum amount of EUR 50.00 (plus 21.00% VAT, if applicable) for each awarded lot or combination (minimum commission).

Administration expenses: These are additional expenses that fall entirely on the successful bidder, intended to cover the services and activities, performed and to be performed, necessary for the preparation, organization and management of the sale of the goods at auction and the post-award phase. These expenses must be paid together with the buyer's premium payment (buyer's fees) according to the provisional award confirmation that will be issued once the auction has ended. If applicable, such expenses will be indicated in the file for each lot. In the case of award of several lots, a reduction of such expenses may be agreed based on the effective collection days and the service offered by Gobid.

Formatting IT Equipment: The successful bidder of the lot of IT equipment must format the equipment that requires it before collection. The cost of formatting will be borne by the successful bidder, who must also certify that the equipment has been wiped in accordance with current regulations.

Decontamination of equipment/elements: If any of the elements require decontamination before collection, the decontamination process, as well as any other procedure necessary for its proper securing, dismantling, collection and transport, in accordance with current regulations, will be the responsibility of the successful bidder, including the associated costs.

Award Taxes: 21.00% VAT, which will be calculated on the award amount of each lot (if applicable).

Bids on the Complete Lot: If no bids are received for the complete lot (Lot 0), the individual lots will be awarded, provided bids have been received, as established in the paragraph "Award of lots". If bids are received both for the Complete Lot (Lot 0) and for individual lots, the Insolvency Administration, at the end of the auction, will have to decide whether to award the Complete Lot or the individual lots, based on the values reached, at its unquestionable judgment.

Extra-Time: If in the last 5 minutes any user places a bid, the deadline will be extended by an additional 5-minute period and the countdown will restart, and so on until no offer is made in the last 5 minutes of extra time. In the case of a maximum bid (proxy bid), automatic increases will be considered valid for the extension of the extra-time period.

The sale of the goods will be carried out in accordance with the condition in which they are found, both as to their physical configuration and their legal status. It is advisable to visit the lots for sale.

All expenses caused by the disposal will be borne by the successful bidder, including collection and transport expenses, any expenses for transfer of ownership, notarial deed and any cancellation in any public registry of the charges or encumbrances established on them. At no time are either the Principal or GOBID ESPAÑA SL responsible for the proper functioning, condition, ITVs, etc. of the lots that make up the asset. For this purpose, their transfer will be made as a specific item.

In the sale, there is no type of post-sale warranty for non-conformity of the good, so that it may not be claimed by any of the purchasers or interested parties.

Therefore, the existence of any damage or lack of quality in the goods sold may not give rise to any extrajudicial or judicial action for compensation or indemnity.

The buyer assumes at their own risk the condition in which the vehicles are found, without being able at any time to exercise any claim on any grounds, including defects or faults, taking into account that they were collected from the street.

Any liability of the Mandatary relating to the existence of third-party rights over the goods subject to the sale is excluded.

The sale is carried out with an obligation on the part of the buyer to assume their own costs and responsibility in order to verify its true conformity with the item offered for sale.

Any liability of GOBID ESPAÑA SL arising from errors or inaccuracies in the translation of the texts and material published on the website is excluded.
