By submitting a bid, the bidder declares that they have fully reviewed and fully accept these conditions of sale and all documentation made available. If a sale notice is attached to the auction sheet/listing, by placing a bid, the bidder declares that they have reviewed and accept the conditions set out therein, in relation to which these conditions of sale are to be understood as an extract. The bidder further declares that they have examined and accepted all documentation made available for the purposes of participation

Deposit

The auction is subject to a security deposit in the amount of EUR 100,00.

Lot 0 requires payment of a deposit equal to EUR 150,00

The deposit must be credited strictly before the auction end.
Once the deposit has been credited, the user will be enabled to participate in the auction.
To speed up participation in the auction, the user is advised to send a scanned accounting copy of the payment made with the CRO code to: [email protected]

If auction participants do not win any goods, the deposit will be returned within 20 working days from the final auction deadline, without interest.

If, in the event of a successful bid, after paying the deposit, the bidder does not complete the purchase, such deposit will be retained.

Availability of Lots

Any registrations relating to pre-emption rights, registrations of attachments and conservatory seizures and any other encumbrance on the goods offered for sale will be cancelled pursuant to Article 217, paragraph 2 of the Italian Civil Code (C.C.I.I.), once the sale has been executed and the price fully collected. Any formality for cancellation will be carried out at the care and expense of the successful bidder.

All costs relating to transfers of ownership, including any double transfers and related charges, will be borne by the successful bidder

In the case of export of registered movable property, the buyer must carry out the required operations in compliance with applicable regulations. Please note that for the purposes of deregistration for export, at the date of the request, the vehicles must be up to date with the inspection obligations established by law.

Payment method

All payments must be made exclusively by bank transfer. The details will be specified either at the time of registration or upon receipt by the user of the award communication (see general conditions).

Payment deadline

The awarded lots must be paid within 5 days from confirmation of provisional award.
The Buyer's Premium and ancillary management charges, where applicable, must be paid within 5 days from confirmation of provisional award.

Collection of awarded lots
 
Collection of the awarded lots by the buyer may take place only after actual receipt of payment of the award price and the applicable fees (Buyer’s Premium, ancillary management charges).
 
In any case, collection must be completed within and no later than 30 days from the provisional award.
 
In order to optimise the collection service, GOBID INTERNATIONAL AUCTION GROUP SRL will notify successful bidders by e-mail of the date(s) and a time during which they may proceed with collection of the lots.  Such dates may also be indicated on the auction web page. GOBID INTERNATIONAL AUCTION GROUP SRL in any case reserves the right to change the indicated collection dates and times at its sole discretion.
 
If the successful bidder collects on dates other than those communicated, they must pay a fee of between EUR 250.00 and EUR 350.00 plus VAT  per day, depending on the quantity of goods to be collected, as additional charges.
 
Successful bidders will be required to comply with the start date of operations. If the successful bidder cannot collect on the communicated day and time, they may:
 
-  subject to approval, request to be admitted during the date(s) scheduled for the next sale attempt, if any.
 
-  subject to approval, collect on days and at times other than those made available for the individual sale attempt, paying an additional fee of between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of goods to be collected, as additional charges
 
Failure to comply with the collection date scheduled between GOBID INTERNATIONAL AUCTION GROUP SRL and the successful bidder will result in the application to the latter of a penalty of EUR 350.00 if the failure to collect is not notified at least 48 hours before the appointment, without prejudice, in any case, to compensation for greater damage suffered by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
All lots not collected within the deadline indicated above will be subject to a daily late fee of EUR 50.00. If the goods are not collected within 30 days from the collection deadline, the sale will be automatically terminated and the amounts paid by the successful bidder (Awarded Lots - Buyer’s Premium, ancillary management charges and any additional charges paid) will be retained as a compensatory penalty. 
 
GOBID INTERNATIONAL AUCTION GROUP SRL is not obliged to deliver any lot nor to organise their collection in any way. 
 
Collection operations must be carried out by the buyer in compliance with current statutory safety regulations; the buyer will therefore be required to make the necessary adaptations in this regard, also with reference to any third parties and/or collaborators employed in carrying out the aforementioned operations.
 
The buyer is responsible for any dismantling, handling, loading and transport of the awarded lots and is required to leave the places involved in collection in safe conditions and free of goods and/or waste materials produced by them during the above operations. In the case of registered movable property, the buyer is understood to be responsible for carrying out the procedures required to effect the necessary transfers of ownership. 
 
Transfers of ownership must therefore be carried out at the care and expense of the successful bidder at the vehicle registration agency communicated by the Procedure Bodies, or alternatively, communicated by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
In the case of export of registered movable property, the buyer must carry out the required operations in compliance with applicable regulations.
 
In any case, GOBID INTERNATIONAL AUCTION GROUP SRL will not make any lot available before receipt of the above payments and, in the case of registered movable property, before completion of the relevant transfer of ownership.
Other specific conditions

Buyer's Premium: A charge of 15,00% + VAT will be added to the hammer price of each lot.

The Buyer’s Premium will have a minimum amount of 25 € (+ 22% VAT where applicable), on each of the lots or combinations awarded, as minimum fees.

Ancillary management charges: They are ancillary costs borne entirely by the successful bidder, intended to cover the services and activities, performed and to be performed, necessary for the preparation, organization and management of the sale of the auctioned goods and the subsequent award phase. Such expenses must be paid at the same time as the payment of the buyer's premium due, as per the provisional award confirmation that will be issued after the end of the auction. Where due, such charges will be indicated in the file of each lot.

VAT: VAT at 22,00% of the sale price will be calculated on the hammer price of each lot. (where applicable)
The procedure is not registered for VIES. VAT will therefore also be due for intra-Community buyers.

Extra-Time: if a winning bid is placed in the 5 minutes preceding the auction closing, the time available to place another bid will be extended by a further 5 minutes from the last bid received. And so on, for each winning bid received within the 5 minutes of extra time, the time available to place another bid will be extended by a further 5 minutes from the last bid received.  Automatic rebids in the event of a maximum bid (proxy bid) will also be considered winning bids.

Bids on the Complete Lot: In the event that no bid is received on the complete lot (Lot 0), the individual lots and/or combinations will be awarded.
In the event that bids are received on the complete lot (Lot 0), the Procedure bodies at the end of the auction reserve the right to award or not award this lot based on the values reached by the individual lots.

The lots are sold as seen and liked in the state in which they are. Viewing is recommended.

The sale of the goods is understood to be forced (Art. 2919 Italian Civil Code) and is arranged for the goods as seen and liked in the factual and legal state in which they are. In a forced sale, the warranty for defects of the item does not apply. It cannot be contested on grounds of damages. (Art. 2922 Italian Civil Code).

Consequently, the existence of any defects or lack of quality or non-conformity of the item sold cannot give rise to compensation, indemnity or reduction of the price.

Any liability on the part of the Mandatary regarding the existence of third-party rights over the goods subject to the sale is excluded (Art. 2920 Italian Civil Code).

The sale takes place with the obligation and burden on the successful bidder to verify their compliance with safety regulations.

In the event of any disputes arising concerning the interpretation of the provisions contained in the general and specific conditions shown on the platform, possibly translated into other languages, the Italian version of the text shall prevail.
