Participation in the auction is reserved for residents in Italy.

Deposit

The auction is subject to a security deposit of the amount of EUR 200,00.

Lot 0 requires the payment of a deposit equal to EUR 1.000,00

The deposit must be credited strictly before the auction end.
Once the deposit has been credited, the user will be enabled to participate in the auction.
To speed up participation in the auction, the user  is advised to send a scanned accounting copy of the payment made with the CRO code to: [email protected]

If auction participants do not win any asset, the deposit will be returned within 30 working days from the final auction deadline, without interest.

If, in the event of a successful bid, after paying the deposit, the bidder does not complete the purchase, such deposit will be retained.

Availability of Lots

Any registrations relating to pre-emption rights, transcriptions of garnishments and conservatory seizures and any other encumbrance on the goods put up for sale will be cancelled pursuant to Art. 108 of the Italian Bankruptcy Law once the sale has been executed and the price fully collected. Any formalities for cancellation will be carried out at the care and expense of the successful bidder.

Any cost relating to transfers of ownership, including any double transfers and related charges, will be borne by the successful bidder

Payment method

The balance of the lot price will be paid via pagoPA in the manner that will be communicated at the end of the auction

The payment of the Buyer's Premium must be made exclusively by bank transfer. The details will be specified either at the time of registration or upon the user's receipt of the award communication (see general conditions).

Payment deadline

The payment of the award price must be made via PagoPa, in the manner that will be communicated to the successful bidder, within no more than 5 days from the award.

The Buyer’s Premium plus VAT must be paid by the successful bidder within 5 days from the award, together with ancillary management charges where provided.

Collection of awarded lots
 
The collection of the awarded lots by the buyer may take place only after the actual receipt of the payments of the award price and the fees provided for (Buyer’s Premium, ancillary management charges).
 
In any case, collection must be completed within and no later than 30 days from the provisional award.
 
In order to optimize the collection service, GOBID INTERNATIONAL AUCTION GROUP SRL will communicate by e-mail to the successful bidders the date(s) and a time during which they may proceed with the collection of the lots.  Such dates may also be indicated on the auction web page. GOBID INTERNATIONAL AUCTION GROUP SRL in any case reserves the right to modify the indicated collection dates and times at its sole discretion.
 
If the successful bidder collects on dates other than those communicated, they must pay a fee ranging from EUR 250.00 to EUR 350.00 plus VAT  per day, depending on the amount of goods to be collected, as additional charges.
 
The successful bidders will be required to comply with the start date of operations. If the successful bidder cannot collect on the communicated day and time, they may:
 
-  upon approval, request to be admitted during the date(s) scheduled for the subsequent sale attempt, if any.
 
-  upon approval, carry out collection on days and times other than those made available for the individual sale attempt, paying a further fee ranging from EUR 250.00 to EUR 350.00 plus VAT per day, depending on the amount of goods to be collected, as additional charges
 
Failure to comply with the  collection date scheduled between GOBID INTERNATIONAL AUCTION GROUP SRL and the successful bidder will result in the application to the latter of a penalty of EUR 350.00 if the failure to collect is not notified at least 48 hours before the appointment, without prejudice, in any case, to compensation for the greater damage suffered by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
All lots not collected within the above term will be subject to a daily penalty of EUR 50.00. In the event that the asset is not collected within 30 days from the collection deadline, the sale will be deemed automatically terminated and the amounts paid by the successful bidder (Awarded Lots - Buyer’s Premium, ancillary management charges and any additional charges paid) will be retained as a compensatory penalty. 
 
GOBID INTERNATIONAL AUCTION GROUP SRL is not required to deliver any lot nor to organize in any way their collection. 
 
The collection operations must be carried out by the buyer in compliance with the applicable safety regulations established by law; the buyer will therefore be required to make the necessary adjustments in this regard also with reference to any third parties and/or collaborators employed in carrying out such operations.
 
The buyer is responsible for any dismantling, handling, loading and transport of the awarded lots and, in the case of registered movable assets, for carrying out the procedures required to effect the necessary transfers of ownership. 
 
The transfers of ownership must therefore be carried out at the care and expense of the successful bidder at the vehicle registration agency communicated by the Procedure Bodies, or alternatively, communicated by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
In the case of export of registered movable assets, the buyer must carry out the required operations in compliance with applicable regulations.
 
In any case, GOBID INTERNATIONAL AUCTION GROUP SRL will not make any lot available before the aforementioned payments have been credited and, in the case of registered movable assets, before completion of the relevant transfer of ownership.
Other specific conditions

The successful bidder is required to remove the liveries present on the vehicle awarded and the equipment therein, before their use; collection of the lot shall be subject to the condition that a specific release declaration has been signed by which the successful bidder assumes the obligation to remove the liveries present on the awarded goods, before their use and in any case within 10 days of collection, with consequent indemnification of the Municipality and/or Gobid International Auction Group s.r.l. from any liability connected thereto. The successful bidder shall be required to provide adequate documentation, including photographic, attesting to the removal of the liveries and related equipment.

Buyer's Premium: A charge of 12,00% + VAT will be added to the award price of each lot.

The Buyer's Premium will have a minimum amount of 25 € (+ 22% VAT where applicable), on each of the lots or combinations awarded, as minimum commissions.

Additional management charges: These are ancillary costs borne entirely by the successful bidder, intended to cover the services and activities, performed and to be performed, necessary for the preparation, organization and management of the sale of the auctioned goods and subsequent award phase. These expenses must be paid at the same time as the payment of the buyer's premium due as per the provisional award confirmation that will be issued after the end of the auction. Where due, such charges will be indicated in the sheet for each lot.

VAT: VAT NOT APPLICABLE

Extra-Time: if a winning bid is placed in the 5 minutes preceding the closing of the auction, the time available to place another bid will be extended by a further 5 minutes from the last bid received. And so on, for each winning bid received within the 5 minutes of extra time, the time available to place another bid will be extended by a further 5 minutes from the last bid received.  Automatic rebids in the event of a maximum offer (proxy bid) will also be considered winning bids.

Bids on the Complete Lot: If no bids are received for the complete lot (Lot 0), the individual lots and/or combinations will be awarded.
If bids are received for the complete lot (Lot 0), the Procedure bodies at the end of the auction reserve the right to award or not award this lot based on the values reached by the individual lots.

The lots are sold as seen and approved in the condition in which they are found. Inspection is recommended.

The sale of the goods is understood to be forced and is arranged for the goods sold as seen and approved in the factual and legal state in which they are found. In a forced sale, the warranty for defects of the item does not apply. It cannot be challenged on grounds of damages.

Consequently, the existence of any defects or lack of quality or non-conformity of the item sold cannot give rise to compensation, indemnity or reduction in price.

Any liability on the part of the Agent regarding the existence of third-party rights over the goods subject to the sale is excluded 

The sale takes place with the obligation and burden on the successful bidder to verify their compliance with safety regulations.

In the event of any disputes arising concerning the interpretation of the provisions contained in the general and specific conditions set out on the platform, possibly translated into other languages, the Italian version of the text shall prevail.
