Likewise, any outstanding amounts for Property Tax, urbanization fees, community expenses, and any fees and all types of expenses accrued and unpaid by the insolvent company that encumber the assets shall be for the buyer's account.

Orders for cancellation of charges shall only be issued by the Court once the Insolvency Administration provides proof of the effective transfer of assets.
The Insolvency Administration will request the Court to cancel charges and registry entries of any kind. The expenses arising therefrom shall be borne by the acquirer.

Award of lots

The sale will be conducted without being subject to a minimum price, although the insolvency administration reserves the right to reject the best offers if it considers them insufficient. For accepted offers, the specialized entity will send provisional award confirmation to the awardee, who will be obliged to make payment of the offered amount.

Warning: the Insolvency Administration reserves the possibility of communicating the winning offer to the Court for its approval. In this case, only once the offer has been approved by the Court will award confirmation be sent to the highest bidder with instructions to make payments within the established deadlines.

Any costs of transfer of ownership, notarial deed and any cancellations in any public registry of charges or encumbrances established on them must be deposited before the date established for formalization of the sale. Payment of the Buyer’s Premium must be made within  10 days from the award notification.

The possibility is provided, subject to prior authorization from the Insolvency Administration, of paying the auction price at the time of formalization of the sale before a notary.

Transfer of ownership

The formalization of the sale of the real estate will be carried out through a public notarial deed according to the conditions established by the Insolvency Administration, only once the award price and the fees (Buyer’s Premium) and other costs arising from the purchase have been paid, with all costs borne by the successful bidder.

The costs of any such liftings will be borne by the successful bidders.

In the event that the highest bidder designated as successful bidder does not attend the granting of the documents necessary for their transfer without the need for a court declaration or express court order, GOBID, in agreement with the Insolvency Administration, may deem them to have withdrawn their purchase offer. The amount deposited as Buyer's Premium will be forfeited and retained as compensation.

Administration costs are established, fully borne by the successful bidder, intended to cover the sale formalization service, which will be organized by GOBID. The administration costs will have a fixed amount that may not exceed €300 + applicable taxes, if any; the exact amount will be detailed in the corresponding lot sheet under the heading "administration costs".
