These Terms govern the terms and conditions of conducting the experiment and apply jointly to:
If the Specific Conditions and/or the Notice of Sale (if any) provide for the application of terms different from those indicated in these General Conditions, the single different provision contained in the Specific Conditions and/or in the Notice of Sale (if any) will prevail.
In the event of any conflict between the provisions of the Specific Conditions and the Notice of Sale, the provisions of the Notice shall prevail.
These conditions, together with the Specific Conditions and/or the Notice of Sale, if any, (collectively, the Conditions of Sale) govern the methods of conduct and participation applied to the Experiment.
By participating, the Registered User declares that he/she has carefully read the Terms of Sale applied to the experiment and accepts them without reservation.
For any information regarding the use of the site and the methods of processing the personal data provided, please refer to the "Terms of Use" and the "Privacy Policy", published on the www.gobidreal.it site.
Gobid Group, through the www.gobidreal.it platform, promotes the sale of the Goods on the basis of the information provided by the Seller, without verification or reprocessing.
For this reason, it should be noted that Gobid Group:
All Goods are sold by the Seller in the condition in which they are at the time of sale ("as is"), without guarantees as to their characteristics or state of preservation.
For this reason, before proceeding with the formulation of the offer, it is strongly recommended to take an adequate view of the Assets, the documentation made available and to carry out independent checks, at one's own care and expense, before proceeding with the formulation of the offer. By completing the process of formulating the offer, as indicated below, the User makes a binding offer; it will therefore not be possible to modify or revoke the offer submitted. Each User is invited to always check their offer before confirming it.

Viewing is not allowed on Saturdays, Sundays and holidays. Please note that viewings will not be guaranteed in the 7 days prior to the deadline for submission of the offer; It is recommended to make the viewing request well in advance.
Where necessary, for viewing purposes, interested parties will be required to provide any required documentation. By requesting a viewing, each interested party declares to be aware that the viewing of the Goods will be carried out under the exclusive responsibility of the interested party, with the express indemnity of Gobid Group and/or the Seller; Gobid Group and the Seller assume no responsibility for any damage to persons and/or property produced during viewing. It is therefore the responsibility of each interested party to carry out the inspection equipped with the necessary precautions according to the nature of the Property being viewed.
The experiment will take place on the www.gobidreal.it platform, according to the terms and conditions indicated in the General Conditions, in the Specific Conditions and in the Notice of Sale, if any, applied to this experiment.
The Auction will take place for the time indicated in the auction sheet; within the identified time frame, each interested party will be able to register for the Auction and make their bid.

Participation in the auction
To participate in the Auction and place a bid, you must:
The combined provision of the crediting of the security deposit, the formalization of the registration for the Auction - with express acceptance of the Conditions of Sale, published online on www.gobidreal.it and the sending by the User of all the supporting documentation, as specified above, will be considered equivalent to an irrevocable offer to purchase at the price set as the starting price for each sale experiment and will constitute, itself, a binding commitment to purchase by the user.
This offer will be formalized on the platform directly by Gobid Group by means of an online bid, on behalf of the first user who has completed the completion procedure described above.
If there are several participants who have formalized their irrevocable purchase offer, according to the procedures described above, and none of the bidders makes a bid on the Platform, the best bidder and, therefore, the successful bidder will be the one who, first, in order of time, will have carried out the procedure already mentioned.
Subsequent bids, in order to be valid, must exceed the best bid received, by an amount at least equal to the minimum raise and be received by the deadline for the end of the tender. They will be formalized directly by the User enabled on the www.gobidreal.it Platform, according to the procedures published on the platform itself. The Auction is subject to a reserve price; all bids lower than the reserve price will be submitted to the Seller who reserves the right to accept or reject them, at its sole discretion. The decisions taken do not give rise to any right on the part of the tenderers and any third parties with regard to the award referred to in the present experiment, including the right to act for any and potential compensation for damages/compensation.
Once the above steps have been completed, Gobid Group will enable the User, who from that moment on, will be able to formulate his offer for the Lot of interest, in accordance with the Conditions of Sale applied.
The data entered by the User during registration on the site will be the same to which the eventual award will be attributed.
All payments required must be made by the subjects registered in the individual auctions.
Security deposit
Participation in the Auction is subject to the receipt of the Security Deposit, as specified in the Specific Conditions of Sale and reported in the Auction registration process.
If the participants in the Auction do not win any Property, unless otherwise indicated in the Specific Conditions, the deposit will be returned within 20 working days from the end of the Auction, without interest.
In the event of the award of one or more lots, the security deposit, unless otherwise indicated in the Specific Conditions, will be returned after the transfer of ownership in favour of the successful bidder.
The security deposit, without prejudice to the right to compensation for greater damages, will be retained as a penalty in the event of failure to comply with the payment terms, for reasons attributable to the Buyer.
Types of offers
The User may choose to formulate his/her bid as a "static bid" or as a "dynamic bid" (proxy bid), as indicated below:- The static bid is considered a fixed price bid, equal to the amount entered by the User in accordance with the Conditions applied to this experiment.- The maximum dynamic bid (proxy bid) is considered a dynamic price bid for the Lot, not visible to other users. When the Registered User enters a static bid, it may be outbid by an offer from other Users. The User, at this point, will be required to enter another static bid to win the Lotto.Se the registered User enters a maximum bid (proxy bid), this will be considered valid until it is exceeded by a bid, by other users, higher than the maximum bid. The bids will be automatic based on the minimum values indicated, aimed at exceeding the other bids submitted until the amount entered is reached. Bids will be considered valid only if submitted within the time frame of the Auction.
Extra-time
If a winning bid is placed in the 5 minutes prior to the closing of the auction, the time to place another bid will be extended by an additional 5 minutes from the last bid received. Thus, to the bitter end, for each winning bid received within the 5 minutes of extra time, the time to make another bid will be extended by a further 5 minutes from the last bid received, for all the Lots included in the Auction. Automatic bids in the event of a maximum bid (proxy bid) will also be considered winning bids.
At the end of the tender, the winner will be the one who has submitted the best valid offer within the deadline for the end of the tender or any extension period.
The terms for payment of the Lot to be awarded, the costs related to the sale and the auction commissions accrued following the award, due to Gobid Group, will start from the Award Confirmation.
Payment must be made within the terms and according to the methods indicated in the Specific Conditions of Sale.
In the event of award, unless otherwise indicated in the Specific Conditions, the security deposit paid for the purpose of participation in the experiment will be made available to the successful bidder, without interest, only following the completion of the transfer of ownership, carried out in accordance with the Specific Conditions of sale to which reference is made.
The transferable effect of the sale in favour of the successful bidder will therefore occur only after the signing of the notarial deed indicated above.
The security deposit may be retained to cover any charges related to the sale, including the Buyer's Premium due, if not paid by the winning bidder, without prejudice to the right to act for the remainder.
It is understood that the transfer of ownership will be arranged only after full payment of the hammer price, the costs related to the sale and the Auction Commissions (Buyer's Premium) due to the auction house Gobid Group for the management of the online experiment.
The buyer is responsible for notary fees, legal taxes and all expenses related to the sale, tax and otherwise.
Unless otherwise indicated in the Specific Conditions of Sale, it is specified that the goods are sold free of encumbrances; if any, the same will be cancelled by and at the expense of the Seller in advance or at the same time as the sale, unless otherwise indicated in the Specific Conditions or agreement between the Parties.
The formulation of the offer in accordance with the Conditions of Sale applied to the online experiment is to be understood as a binding commitment to purchase by the User, therefore, in the event of non-payment within the established term, for reasons attributable to him, the award will be declared forfeited, the sale terminated and the deposit paid will be retained as a compensation penalty, without prejudice to the right to act for compensation for greater damages.
The successful bidder will be charged with the commissions/auction fees (Buyer's Premium), plus VAT, due to Gobid Group for the management of the experiment, to be calculated as a percentage of the hammer price, as indicated in the Specific Conditions of Sale, to which reference is made.
The right to payment of the Buyer's Premium accrues with the award; without prejudice to the provisions of the section "Award, method of payment of the price and transfer of ownership", in the event of non-payment, even partial, Gobid Group reserves the right to take action for the compulsory recovery of the credit, without prejudice to any further rights and actions provided for by law.
In the event of forfeiture of the award for reasons attributable to the successful bidder, the same will in any case be required to pay the above-mentioned dues, which, if paid, will therefore be retained by Gobid Group.
All sales experiments are published on the www.gobidreal.it website, with an indication of the dates of the experiment, Conditions of Sale, information on the lots eligible for bidding and details of the experiment.
The duration of the Experiment is indicated in the Auction form as well as in the specific conditions and/or in the Notice of Sale (if any). Where not specified, the times shown in the specific conditions and on the platform refer to the time zone indicated in the server time published on the site.
It is understood that, at the sole discretion of Gobid Group and/or the Seller, the experiment or the award may in any case be suspended and/or deferred, even due to technical problems of connection to the system, dependent on server or network malfunctions, without this being able to determine the recognition of any claim for compensation or indemnity in favor of the registered user and/or the winning bidder.
All transactions carried out on the platform by the user are subject to registration. The recordings on the log file, generated by the system, constitute full and exclusive proof between all parties to this competitive procedure, regarding the content and timing of the documents/messages exchanged electronically. Registrants declare and acknowledge that the system registrations are full proof of the relationship between them. These recordings are confidential and will not be disclosed to third parties, except in the cases expressly provided for or by order of the Judicial Authority.
GOBID INTERNATIONAL AUCTION GROUP SRL cannot, in any case, be held responsible for any malfunctions of the system that in any way may affect or delay the delivery of communications to the person who registers, nor for the unavailability of viewing and/or use of www.gobidreal.it and illicit use of www.gobidreal.it by Users.
GOBID INTERNATIONAL AUCTION GROUP SRL reserves the right to cancel the bids submitted if inconsistencies are detected with what is indicated in the Conditions of Sale applied to the experiment of interest.
In the event of any disputes relating to the interpretation of the provisions contained in the general and specific conditions reported on the platform, possibly translated into other languages, the Italian version of the text will prevail.
Each Item is sold by the Seller in accordance with the "as is" clause, in the state in which it is at the time of sale, without guarantees.
The existence of any defects, lack of quality or discrepancies of the thing sold, charges of any kind, cannot give rise to any compensation, indemnity or reduction of the price.
Gobid Group, through the www.gobidreal.it platform, promotes the sale of the Goods owned by the Seller, according to the information provided by the same, without reprocessing and verification. For this reason, Gobid Group is not responsible for any errors, omissions and inaccuracies in the online information.
It should also be noted that Gobid Group does not own or be considered as the Custodian of the Goods subject to this experiment, which are the property of the Seller.
Gobid Group is therefore not liable for any defects, defects or lack of quality, total or partial, of the Goods offered for sale.

It is the responsibility of each participant to take a prior, complete and accurate view of the General and Specific Terms and Conditions of Sale applied to this experiment, of the documentation published online.
Given the above, with the formulation of the bid, the User declares to be aware that Gobid Group is not responsible for any errors, omissions and inaccuracies in the photos, descriptions, quantities and any other detail indicated in the Auction.
