SPECIFIC TERMS AND CONDITIONS
By submitting a bid, the bidder declares that they have fully read and accept these conditions of sale and all the documentation provided. If there is a notice of sale attached to the auction form/announcement, by submitting a bid, the bidder declares that they have read and accept the conditions contained therein, of which these conditions of sale are to be considered an extract. The bidder also declares that they have examined and accepted all the documentation provided for the purposes of participation.

Deposit has to be necessarily credited before the auction deadline.
As soon as the deposit will be received, the user will be immediately allowed to bid.
In case of deposit payment via bank tranfers, in order to accelerate the participation, the user is advised to send an official proof of the deposit payment to the following address: [email protected]
In case participants will not award any lot, deposit will be refunded within 20 working days from auction deadline, with no interests applied.
If, in case of awarding, after deposit payment, the bidder will not comply with the payment terms, the deposit will not be refunded.
Participation Procedure
To participate in the sale, interested users will be asked to first register on the website www.gobid.it and then for the relevant auction, expressly accepting the General Conditions and Specific Conditions. The data entered by the user during the auction registration process will be the same as those in favor of the eventual award and subsequent transfer of the item.
The user must pay the required security deposit and down payment for expenses via bank transfer to the current account indicated in the specific conditions of sale and on the registration page, following the instructions in the specific conditions of sale and indicated during registration.
In addition to the security deposit and down payment for expenses, to be authorized to participate in the auction, the user must provide the following documents by uploading them in the "My Documents" section or by sending them to [email protected].
• Copy of the security deposit transfer.
If the bidder is a NATURAL INDIVIDUAL:
• Copy of a valid identity document.
• Copy of the tax code.
• If the bidder is married under a joint ownership regime, the corresponding spouse's information must also be provided, along with a copy of the relevant identity document (this document is not binding for qualification purposes but is required in the event of a successful bid).
• If the bidder is a minor/under interdiction/disqualified, the bid must be signed by the guardian with the prior authorization of the guardianship judge, which must be attached;
If the bidder is a LEGAL ENTITY:
• Chamber of Commerce certificate (the document must have been issued within 6 months prior to the bid date).
• Copy of a valid identity document of the person signing the bid on behalf of the company and, if they lack the necessary signature authority or if the person is not the legal representative, a copy of the document certifying their authority.
• Copy of the tax code of the person signing the bid.
• Any duly certified translation of the Chamber of Commerce certificate, if the company is not Italian.
• Special power of attorney received or certified by a notary, in the case of participation through a representative.
Following the payment of the security deposit and down payment, as well as the submission of the required documentation, as indicated above, the user will be required to wait for authorization from Gobid.it. Once authorization is received (after the deposit and down payment have been collected), the registered user will be able to place bids online within the lot's page on www.gobid.it until the auction ends. At the end of the auction, the lot awarding process will begin, lasting a maximum of 48 business hours, unless otherwise specified in the specific conditions. At the end of the awarding process, the highest bidder will be notified of the award.
Bids placed are binding and constitute a formal purchase commitment.
For anything not expressly mentioned here (for example, but not limited to, failure to comply with the conditions of sale, buyer's fees, and the operation of the extra time), please refer to the conditions of sale published on the website www.gobid.it.
All payments have to be made exclusively by bank transfer. Account details will be indicated whether at the time of registration or in conjunction with the awarding statement (in a private message to the user mailbox). (see General Terms and Conditions)
Payment deadline
The lots awarded to the user must be paid within 10 days from the confirmation of provisional awarding.
The Buyer's Premium and any additional management fees, if applicable, must be paid within 10 days from the confirmation of provisional awarding.
Property transfer
Property transfer will take place with a deed issued by the Notary Public, identified by the procedure, only after full payment of the hammer price, expenses and Buyer's Premium.
In case of lack property transfer finalization, the sale will be canceled and the amount paid by the user who awarded the lot as Buyer's Premium will not be refunded, as a penalty.
It should be noted that, with the award of the company branch, the buyer undertakes to take over all the contractual relationships pending at the final award date, as these are an integral part of the goodwill of the company in liquidation and of the value company of the same.
Additional specific terms
Buyer's Premium: A charge of 12,00% + VAT will be added to the price of each awarded lot.
Additional management fees: These are the ancillary costs entirely borne by the successful bidder, intended to cover the services and activities, performed and to be performed, necessary for the preparation, organization, and management of the sale of the goods at auction and subsequent adjudication phase. These expenses must be paid together with the payment of the buyer's premium due as per the provisional award confirmation that will be issued after the end of the auction. Where due, these charges will be indicated in the sheet of each lot.
VAT: not due. Sale is subject to registration tax.
Extra-Time
In case a winning offer will be submitted within 5 minutes before the auction deadline, the time to place another bid will be extended for 5 more minutes from the last bid received. Every other winning bid submitted within 5 extra-time minutes, will extend the time for placing another bid for 5 more minutes from the last bid received and so forth.Automatic overbids in case of maximum bid (proxy bid) are condisdered winnig bids as well.
Lots are sold as is. Viewing is reccomended.
Possible adaptations of the goods to all the regulations in force and in particular to those of prevention, safety as well as those concerning ecological and environmental protection and - more generally - the regulations in force will be the sole responsibility of the purchaser who will bear any expense with exemption from from any liability in this regard. Any instrumental goods that do not comply with the regulations currently in force on the subject, where included in the inventory, will be considered the object of the sale only as goods for spare parts, with the exclusion of any responsibility of the Curate for the hypothesis of use of the same by the transferee. . In particular, for any goods that do not comply with safety regulations, without the CE mark, the contractor is obliged to proceed, at his own exclusive care, charge and risk, to their compliance with the law or, if it is not found to be possible, to their disposal in the forms of the law.
The sale of the goods is forced (art. 2919 c.c.) it is arranged for goods as is , in the rule of law and fact. In the forced sale it is not valid the warranty for vices. It cannot be contested for damages (Art. 2922 c.c.).
The sale occurs with obligation for the user who award the lot to check of the compliance with safety norms
It is excluded any responisibility of the Agent about the existence of rights of third parties on the goods subject of sale (Art . 2920 Civil Code)
