By submitting the bid, the bidder declares to have fully reviewed and to fully accept these conditions of sale and all documentation made available. If there is a notice of sale attached to the auction sheet/announcement, by submitting the bid, the bidder declares to have reviewed and to accept the conditions set out therein, with respect to which these conditions of sale are to be understood as an extract. The bidder further declares to have examined and accepted all documentation made available for participation

Deposit

The auction is subject to a security deposit of the amount of EUR 1.600,00.

The deposit must be credited strictly before the auction end.
Once the deposit has been credited, the user will be enabled to participate in the auction.
To speed up participation in the auction, the user is advised to send a scanned accounting copy of the payment made with the CRO code to: [email protected]

If auction participants do not win any asset, the deposit will be returned within 20 working days of the final auction end, without interest.

If, in the event of a successful bid, after paying the deposit, the bidder does not complete the purchase, such deposit will be retained.

Availability of Lots

Any registrations relating to pre-emption rights, registrations of pledges and protective seizures and any other restriction burdening the assets put up for sale will be cancelled pursuant to Art. 217, paragraph 2 of the Italian Bankruptcy Code, once the sale has been executed and the price fully collected. All formalities for cancellation will be carried out at the expense of the successful bidder.

All costs relating to transfers of ownership, including any double transfers and related charges, will be borne by the successful bidder

In the case of export of registered movable assets, the buyer must carry out the required operations in compliance with applicable regulations. Please note that for deregistration for export, at the date of the request, the vehicles must be up to date with the inspection obligations required by law.

Payment method

All payments must be made exclusively by bank transfer. The details will be specified either at the time of registration or upon receipt by the user of the award communication (see general conditions).

Payment deadline

The awarded lots must be paid within 5 days from confirmation of provisional award.
The Buyer's Premium and ancillary management charges, where applicable, must be paid within 5 days from confirmation of provisional award.

Collection of awarded lots
 
Collection of the awarded lots by the buyer may take place only after actual receipt of payment of the award price and the applicable fees (Buyer's Premium, ancillary management charges).
 
In any case, collection must be completed no later than 30 days from the provisional award.
 
In order to optimise the collection service, GOBID INTERNATIONAL AUCTION GROUP SRL will notify the successful bidders by e-mail of the date(s) and a time during which they may collect the lots.  Such dates may also be indicated on the auction web page. GOBID INTERNATIONAL AUCTION GROUP SRL in any case reserves the right to change the collection dates and times indicated at its sole discretion.
 
If the successful bidder collects on dates other than those communicated, they must pay a fee of between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of goods to be collected, as additional charges.
 
Successful bidders will be required to comply with the start date of operations. If the successful bidder cannot collect on the day and at the time communicated, they may:
 
-  subject to approval, request admission to the date(s) scheduled for the subsequent sale attempt, if any.
 
-  subject to approval, collect on days and at times other than those made available for the individual sale attempt, paying an additional fee of between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of goods to be collected, as additional charges
 
Failure to comply with the collection date scheduled between GOBID INTERNATIONAL AUCTION GROUP SRL and the successful bidder will result in the application to the latter of a penalty of EUR 350.00 if the failure to collect is not notified at least 48 hours before the appointment, without prejudice, in any case, to compensation for greater damage suffered by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
All lots not collected within the deadline indicated above will be subject to a daily late fee of EUR 50.00. If the asset is not collected within 30 days of the collection deadline, the sale will be deemed automatically terminated and the amounts paid by the successful bidder (Awarded Lots - Buyer's Premium, ancillary management charges and any additional fees paid) will be retained as a compensatory penalty. 
 
GOBID INTERNATIONAL AUCTION GROUP SRL is not required to deliver any lot nor to organise in any way their collection. 
 
Collection operations must be carried out by the buyer in compliance with applicable safety regulations laid down by law; the buyer will therefore be required to make any necessary adjustments in this regard, also with reference to any third parties and/or collaborators employed in carrying out the aforementioned operations.
 
The buyer is responsible for any disassembly, handling, loading and transport of the awarded lots and is required to leave the places involved in the collection in safe conditions and free of goods and/or waste materials produced by them during the aforementioned operations. In the case of registered movable assets, the buyer shall be understood as responsible for handling the paperwork required to carry out the necessary transfers of ownership. 
 
Transfers of ownership must therefore be carried out at the expense of the successful bidder at the motor vehicle registration agency communicated by the Procedure Bodies, or alternatively, communicated by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
In the case of export of registered movable assets, the buyer must carry out the required operations in compliance with applicable regulations.
 
In any case, GOBID INTERNATIONAL AUCTION GROUP SRL will not make any lot available before the aforementioned payments have been credited and, in the case of registered movable assets, before completion of the relevant transfer of ownership.
Other specific conditions

Buyer's Premium: A charge of 12,00% + VAT will be added to the hammer price of each lot.

The Buyer’s Premium will have a minimum amount of €25 (+ 22% VAT where applicable), on each lot or combination awarded, as minimum fees.

Additional management charges: These are additional costs entirely borne by the winning bidder, intended to cover the services and activities, performed and to be performed, necessary for the preparation, organization and management of the sale of the auctioned goods and the subsequent award phase. These expenses must be paid at the same time as the buyer's premium due, as per the provisional award confirmation that will be issued after the end of the auction. Where due, such charges will be indicated in the description of each lot.

VAT: VAT at 22,00% of the sale price will be calculated on the hammer price of each lot. (where applicable)

Extra-Time: if a winning bid is placed within 5 minutes before the close of the auction, the time available to place another bid will be extended by an additional 5 minutes from the last bid received. And so on, for each winning bid received within the 5 minutes of extra time, the time available to place another bid will be extended by a further 5 minutes from the last bid received.  Automatic bids in the case of a maximum bid (proxy bid) will also be considered winning bids.

The lots are sold as seen and approved in the condition in which they are found. Viewing is recommended.

The sale of the goods is intended as forced (Art. 2919 Italian Civil Code) and is arranged for the goods sold as seen and approved in the factual and legal condition in which they are found. In a forced sale there is no warranty for defects in the item. It cannot be contested on grounds of damages. (Art. 2922 Italian Civil Code).

Consequently, the existence of any defects or lack of quality or discrepancies in the item sold cannot give rise to compensation, indemnity or price reduction.

Any liability on the part of the Agent regarding the existence of third-party rights over the goods subject to the sale is excluded (Art. 2920 Italian Civil Code).

The sale takes place with the obligation and burden on the winning bidder to verify their compliance with safety regulations.

In the event of any disputes arising relating to the interpretation of the provisions contained in the general and specific conditions shown on the platform, possibly translated into other languages, the Italian version of the text shall prevail.
