Deposit
To participate in the Auction, it is necessary to pay a deposit of EUR 6.000,00.

The deposit must be paid before the end of the Auction.
Only once the deposit has been received will the user be authorized to participate in the Auction.
To speed up participation in the auction, it is recommended to send proof of payment to [email protected].
Privileged creditors related to the real estate for sale in this auction are exempt from providing the deposit to participate in the bidding for those lots for which they hold the credit. To participate in the auction, they must send an email indicating their position and provide the documentation required for participation, except for the proof of deposit payment.
Users who have participated in the Auction but have not been awarded any assets will receive their deposit back within 20 business days following the conclusion of the auction, without interest.
If, after having made the deposit and having been awarded the lot for sale, the bidder does not complete the acquisition by paying the sale price and the Buyer’s Premium, said deposit will be withheld.
In this case, the award will be attributed to the next highest bidder who has made an offer equal to or above the reserve price.
Charges and Encumbrances
The sale will be carried out free of charges and encumbrances, with the exception of restrictive rights of ownership, legal affections, and corresponding urban planning charges.
Furthermore, taxes, duties, and levies relating to the award, sale, or transfer of each asset will be at the expense and responsibility of the successful bidders or buyers, who will also assume notary fees, registration fees, and any others related to the sale, including the municipal capital gains tax (plusvalía). In no case will the bankrupt company bear any type of expense related to the sale. Likewise, any outstanding amounts for Property Tax (IBI), urbanization fees, community expenses, and those taxes and all types of expenses accrued and not satisfied by the bankrupt company that encumber the assets will be the buyer's responsibility.
The orders for the cancellation of charges will only be issued by the Court once the Insolvency Administration provides proof of the effective transfer of the assets.
The Insolvency Administration will request the Court to cancel the charges and registry annotations of both embargoes and those arising from the insolvency proceedings; the resulting expenses will be borne by the purchaser.
Awarding of Lots
The sale will be carried out without a minimum reserve price. Notwithstanding, the Insolvency Administration reserves the right to reject even the highest bid if it is deemed insufficient.
Regarding accepted offers, the specialized entity will send the successful bidder a provisional award confirmation, and the latter shall be obliged to pay the bid amount under the established terms and deadlines.
When the highest bid submitted in the auction is lower than the amount of the special privileged debt secured by the property, the award of the asset free of liens and encumbrances will require the express consent of the privileged creditor.
Should such consent not be granted, the highest bidder will be offered the possibility of being awarded the asset through subrogation of the secured debt. If the highest bidder does not accept said subrogation, the Insolvency Administration may declare the auction void or proceed in the manner it deems most appropriate for the interests of the insolvency proceedings.
Warning: The Insolvency Administration reserves the right to submit the winning bid to the Court for approval. In such a case, the award shall only be considered confirmed once judicial approval has been obtained. Following this, the confirmation of the award will be sent to the highest bidder with instructions to make the payments within the scheduled timeframes.
Method of Participation
To participate in the auction, the user must register on the website www.gobid.es, adding their personal data, request registration for the auction, and accept its terms and conditions.
The data included at the time of registration on the auction page will be the same used to assign the award of the sale, the lots, and their ownership.
All required payments, before and after the sale, must be paid by the registered users. Any powers of attorney will be taken into account only in the case of authorization from the Principal.
The user must deposit the required amount for participation in the auction into the bank account specified above.
The user must specify the auction number and the number of lots they wish to participate in and simultaneously send proof of the transfer made to the email address [email protected].
The deposit must mandatory be credited before the end of the auction.
In addition to the deposit, to be authorized to participate in the auction, the user must provide the documentation listed below by sending it to the address [email protected].
FOR INDIVIDUALS:
Copy of a valid ID (DNI/Passport) of the person to whom the transfer of ownership of the lot will be awarded.
If the bidder is a spouse under a community property regime, they must also provide the spouse's details by sending a copy of their ID (non-binding document for auction eligibility, but required in case of award).
FOR COMPANIES OR ENTITIES:
Copy of the deed of incorporation of the Company stating the formation of the Company and the powers granted to the bidder.
Copy of a valid ID of the administrator or legal representative.
Sworn translation of the deed of incorporation, in case the company is not Spanish.
Power of attorney authorized by a notary, in the case of participation through a representative.
Method of Payment
The payment of the Buyer’s Premium must be made entirely by bank transfer using the accounts communicated at the time of registration or together with the award communication (see general auction conditions).
The provisional successful bidder must deposit the total closing price plus VAT (if applicable) into the account of the bankrupt company, which will be indicated at the time of sending the award confirmation, within the established period (see general conditions).
Any costs for transfer of ownership, notary deeds, and any cancellations in any public registry of the charges or encumbrances established on them must be deposited before the date established for the formalization of the sale. Once all amounts have been paid, the transfer of ownership will proceed through a notary deed, according to the methods established by the Principal.
Payment Deadline
The payment of the Buyer’s Premium must be made within 10 days from the award communication.
The payment of the award price must be made within 20 days from the award communication.
The possibility is foreseen, subject to authorization by the Insolvency Administration, to pay the closing price at the time of formalization of the sale before a notary.
Transfer of Property
The formalization of the sale of real estate will be carried out through a public notary deed according to the conditions established by the Insolvency Administration, only once the award price, the fees (Buyer’s Premium), and other expenses derived from the purchase have been paid, with all costs being assumed by the successful bidder.
Formalization must take place within a maximum period of 20 days from the sending of the award confirmation, this period being extendable only by the Insolvency Administration.
The Principal will finally be responsible for requesting the Judicial Secretary to proceed with the lifting of embargoes, charges, and annotations arising from the insolvency proceeding that weigh on the transferred assets through the delivery of the corresponding orders. The costs of any liftings will be borne by the successful bidders.
In the event that the highest bidder designated as the awardee does not attend the granting of the documents necessary for their transfer without the need for express judicial declaration or intimation, the Agent, in agreement with the Principal, may consider them to have withdrawn their purchase offer. The amount deposited as Buyer's Premium will be lost and retained as compensation.
Administration expenses are established, fully assumed by the successful bidder, intended to cover the sale formalization service, which will be organized by the Agent. The administration expenses will have a fixed amount that cannot exceed €300; the exact amount is detailed in the corresponding lot file under the concept "administration expenses."
Other Specific Conditions
Buyer’s Premium: The bidder who becomes the final awardee must pay the auction house fees, which are set at: 5,00% on the final award price of each lot, plus 21% VAT (if applicable).
The Buyer’s Premium will have a minimum amount of 500 euros (plus 21.00% VAT, if applicable) per lot (minimum commission).
The payment of the commission (Buyer’s Premium) will be at the expense of the purchaser or successful bidder, whether or not they are the creditor with special privilege.
Assets subject to privileged credits
Creditors with special privilege will not be obliged to provide the deposit.
The holder of the credit with special privilege is given the option to assign the award they obtain.
The creditor with special privilege, in the event of an award, will be obliged to pay the fees of the specialized entity.
Award Taxes: VAT and/or any tax that is applicable according to the regulations and the successful bidder will be applied.
Extra-Time: In the event that any user places a bid in the last 5 minutes, the period will be extended for a further 5 minutes and the countdown will start again, and so on until no offer is made in the last 5 minutes of extra-time. In the case of a maximum bid (proxy bid), automatic increments will be considered valid for the extension of the extra-time period.
The sale of the assets will be carried out in accordance with the situation in which they are found, both in terms of their physical configuration and their legal status. Furthermore, whoever submits an offer does so by accepting the current registry and urban planning conditions. It is recommended to visit the lots for sale.
All expenses caused by the sale will be on account of the successful bidder, including removal and transport costs, any costs for transfer of ownership, notary deeds, and any cancellations in any public registry of the charges or encumbrances established on them.
Successful bidders or buyers of any lot or asset expressly waive any claim due to the state of the asset. For these purposes, interested parties who expressly request it will be allowed to check the state of the assets included in the Lots, on the days previously fixed for this purpose. At no time is the Principal or GOBID ESPAÑA SL responsible for the proper functioning, state, ITVs (technical inspections), etc., of the lots that make up the asset. To this effect, their transfer will be carried out as a "certain body" (as is).
In the sale, no type of post-sale guarantee takes place due to the non-conformity of the asset, so this cannot be claimed by any of the purchasers or interested parties.
Therefore, the existence of any damages or lack of quality in the assets sold cannot give rise to any extrajudicial or judicial action for compensation or restitution.
Any liability of the Agent regarding the existence of third-party rights over the assets object of the sale is excluded.
The sale is made with the obligation on the part of the buyer to assume their own expenses and responsibility for the purposes of verifying their true conformity with the asset offered for sale.
Any liability of GOBID ESPAÑA SL derived from errors or inaccuracies in the translation of the texts and material published on the website is excluded.
