TERMS AND SPECIFIC CONDITIONS

By submitting the bid, the bidder declares to have fully reviewed and to accept in full these conditions of sale and all documentation made available. If a sale notice is attached to the auction/ad lot sheet, with the submission of the bid, the bidder declares to have reviewed and to accept the conditions set out therein, with respect to which these conditions of sale are to be understood as an extract. The bidder further declares to have examined and accepted all documentation made available for the purposes of participation.

Deposit

Participation in the auction is subject to the payment of a mandatory security deposit equal to EUR 0,00.

Availability of Lots

Any registrations relating to pre-emption rights, transcriptions of foreclosures and conservatory seizures and any other restriction encumbering the assets put up for sale will be cancelled pursuant to Art. 108 of the Bankruptcy Law once the sale has been completed and the price fully collected. All formalities for cancellation will be carried out by and at the expense of the successful bidder.

Pursuant to Art. 105, second paragraph, of the Bankruptcy Law, which refers to Art. 2556 of the Civil Code, the sale will be completed by notarial deed at the purchaser's expense.

The sale will be subject to the taxes provided for by law in this matter.


Payment deadline

The lots awarded by the user must be paid in full within 90 days of the award.

The Buyer's Premium due (plus VAT) must be paid within 10 days of the award.

The costs relating to the sale borne by the purchaser (fiscal and non-fiscal charges, statutory taxes, notarial costs) must be paid within 90 days of the award  


Buyer's Premium: A percentage charge of 7,00% + VAT will be added to the award price of each lot also in the case of bids received within the deadline provided for by Art. 107, paragraph 4 (Bankruptcy Law).

The Buyer’s Premium will have a minimum amount of € 500.00 (+ 22% VAT where applicable) as the minimum invoiced commission if the reference percentage applied to the sale value is lower
 

VAT on the Lot: The VAT application percentage may vary as required by law and will be calculated on the award price of each lot (where applicable).


In the event of any disputes arising regarding the interpretation of the provisions contained in the general and specific conditions shown on the platform, possibly translated into other languages, the Italian version of the text shall prevail.
