Deposit

The present auction is subject to a deposit of EUR 6.100,00.

Payment deadline

Payment for the lot must be made in accordance with the provisions of the draft business lease agreement attached to the auction sheet, to which reference is made for any further information.

Buyer's premium due has to be paid within 10 days from awarding.

Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 30 days from the provisional awarding.

The company lease agreement will be signed only after full payment of the awarding price, unless otherwise indicated by the Principal, the expenses and the Buyer's Premium, by means of a notarial deed according to the methods established by the Principal himself.

Buyer's Premium:

equal to one month (plus VAT) calculated on the annual rent resulting from the award at the end of the auction

VAT:

VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)

In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts

The Company does not include debts and credits prior to the effective date of the lease, which remain exclusively the responsibility of the Lessor.

Inventory, currently non-existent, is not included in the business assets subject to this notice. If existing at the time of signing the company lease contract, they will be sold at cost by the Lessor to the Lessee at the time of taking possession of the business complex. They will be regularly invoiced and the payment, including VAT, will be made by the lessee in six monthly installments starting from the month of invoice issuance.

The Lessor undertakes to transfer to the Lessee the necessary authorizations if and as far as they relate to the exercise of the leased activity; this transfer will be effective until the expiration of the company lease.

The company lease contract is subject to the suspensive condition that the Emilia Romagna Region, with acknowledgment or equivalent act, authorizes the entry of the Lessee into the authorizations that are held by the company in Judicial Administration.

The lease will last for five years. It is at the Lessor's discretion to request, at least three months before the expiration, the extension of the duration of this contract.

The activity is carried out in a property owned by third parties. The contract, registered on 22/10/2015, has a duration of 6 years with an initial expiration on 04/10/2021 and has been renewed for an additional 6 years, thus until 04/10/2027, and contains a clause for automatic renewal.
