Deposit

To participate in the Auction, it is necessary to pay a security deposit of EUR 1.000,00.

Lots with an estimated value equal to or greater than EUR 1,000.00 require the payment of a specific deposit indicated in the corresponding lot sheets.Payment of the specific deposit for a lot unlocks eligibility for individual lots with the general security deposit (basic deposit).

Lot 0 requires a deposit of EUR 30.000,00.

The deposit must be made by bank transfer to the following account:

Reference: auction number and lot number

Interested users must pay the above-mentioned deposit before the end of the Auction.
Only once the deposit has been received will the user be authorized to participate in the Auction.
To speed up participation in the auction, it is recommended to send proof of payment to info@gobid.es

Users who have participated in the Auction but have not been awarded any goods will receive their deposit within 20 business days from the payment of the award amount.
If no lots are awarded, the deposit will be refunded within 20 business days from the conclusion of the auction.

If, after having made the deposit and being awarded the lot, the bidder fails to complete the acquisition by paying the sale price and Buyer’s Premium, the deposit will be retained.

In this case, the award will be assigned to the next highest bidder who made an offer equal to or above the reserve price.

Encumbrances

The sale of the goods is carried out free of charges and encumbrances.
However, all taxes, fees, and levies legally applicable to the award, sale, or transfer of each asset will be borne by the awardees or buyers.

It is noted that the vehicles have pending municipal IVTM taxes which will be the responsibility of the awardee. The amount of the pending tax is detailed in the lot sheet.

Lot Award

At the end of the auction, if the winning bid is equal to or greater than the reserve price, an award confirmation will be sent to the highest bidder with the instructions for making the payments within the established deadlines.

If the offer does not reach the minimum or reserve price, the award must be approved by the Insolvency Administration.

Warning: the Insolvency Administration reserves the right to submit the winning offer to the Court for approval. In such a case, only once the offer is approved by the Court will an award confirmation be sent to the highest bidder with the instructions for making the payments within the established deadlines.

Payment Method

All payments must be made exclusively by bank transfer using the accounts provided at registration or along with the award confirmation (see general auction conditions).

Payment Deadline

The payment of the award price of the lots must be made within 10 days from the award communication.

The payment of the Buyer’s Premium must be made within 5 days from the award communication.

Withdrawal Conditions

In any case, the withdrawal must be completed no later than 20 days from the provisional award confirmation.

If the goods are not withdrawn within the indicated timeframe, the sale will be considered cancelled and the amounts paid by the awardee (awarded lots – Buyer’s Premium, additional administrative costs and any paid ancillary charges) will be retained as compensation for the damage caused.

The withdrawal will be managed according to the conditions established by the Insolvency Administration and the bankrupt entity. GOBID ESPAÑA S.L. is not obliged to deliver any lot nor to organize its removal or delivery in any way.

The removal operations must be carried out by the buyer in compliance with current legal safety regulations; therefore, they will be required to make the necessary adjustments, even when involving third parties and/or collaborators engaged in carrying out the mentioned operations.

The awardee is responsible for any disassembly, movement, loading, and transport of the awarded lots and, in the case of vehicles, also for the transfer of ownership and any related formalities.

In any case, no lot will be made available before previous payments have been completed and, in the case of registered movable goods, before the relevant ownership transfer is completed.

Other Specific Conditions

Buyer’s Premium: a charge of 10,00% (plus 21% VAT, if applicable) of the award price of each lot, which will be added to it.

The Buyer’s Premium will have a minimum amount of 50 euros (plus 21% VAT, if applicable) for each awarded lot or awarded combination (minimum commission).

Administrative Fees: These are additional fees entirely borne by the awardee, aimed at covering the services and activities, performed and to be performed, necessary for the preparation, organization, and management of the asset sale and the post-sale phase. These fees must be paid together with the Buyer’s Premium (buyer’s fees) according to the provisional award confirmation issued once the auction ends. If applicable, these fees will be indicated in the lot sheet.

Formatting of IT Equipment: The awardee of the IT equipment lot must format the devices that require it before withdrawal. The cost of formatting shall be borne by the awardee, who must also prove that the devices have been wiped in accordance with current regulations.

Decontamination of Equipment/Items: If any of the items require decontamination before removal, the decontamination process as well as any other necessary procedures for proper safety, disassembly, removal, and transport in compliance with current regulations, will be the responsibility of the awardee, including the related costs.

Award Taxes: 21.00% VAT, which will be calculated on the award amount of each lot (if applicable).

Offers on the Complete Lot: If no offers are received for the complete lot (Lot 0), the individual lots will be awarded, provided that they have received offers, according to what is established in the “Lot Award” paragraph.
If offers are received for both the Complete Lot (Lot 0) and the individual lots, the Insolvency Administration, at the end of the auction, must decide whether to award the Complete Lot or the individual lots, based on the values reached, at its sole discretion.

Extra-Time: In the event that a user places a bid in the last 5 minutes, the deadline will be extended by another 5 minutes and the countdown will restart; this will continue until no further bids are placed in the final 5 minutes of extra-time. In the case of maximum bid (proxy bid), automatic increments will be considered valid for extra-time extension.

The sale of goods will be carried out according to their existing state, both in terms of physical configuration and legal status. It is advisable to inspect the lots offered for sale.

All costs incurred by the disposal shall be borne by the awardee, including removal and transport costs, possible ownership transfer fees, notarial deeds, and the possible cancellation of charges or encumbrances from any public register.

There is no guarantee of conformity of the goods after the sale, and therefore no claims may be made by any purchaser or interested party.

Consequently, the existence of any damage or lack of quality in the sold goods shall not give rise to any extrajudicial or judicial compensation or reimbursement claims.

The buyer assumes full responsibility for the condition of the vehicles, and shall not be entitled to make any claim for any reason, including hidden defects, considering that the vehicles were collected from the street.

Any liability of the Seller regarding the existence of third-party rights over the sold goods is excluded.

The sale is carried out with the obligation for the buyer to bear their own costs and responsibility for verifying the actual conformity of the goods offered for sale.

Any liability of GOBID ESPAÑA SL for errors or inaccuracies in the translation of the texts and materials published on the website is excluded.
