The present auction is subject to a deposit of

Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on Procedure's expenses.
Property transfer
The transfer of ownership will take place only after full payment of the hammer price, expenses and Buyer's Premium by notarial deed with Notary with Studio in the Province of Trento chosen by the Mandator
Payment deadline
Awarded lots have to be paid in full within 60 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 15 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 60 days from the provisional awarding.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
Naglašava se da se imovina prodaje u cijelosti, s obzirom na to da je sklopljen predugovor o kupoprodaji od 04/05/2022, redovito upisan, koji se odnosi na prijenos u korist društva u stečaju - već vlasnika dijela od 1/2 - ili trećim osobama koje će biti imenovane za preostali dio zemljišta, koji će se stoga prenijeti nakon dodjele.
Građevinska zemljišta od 12.425 m² spadaju u građevinsku zonu označenu kao C3.2 Lu Gialdinu i pripadaju podzoni C1.10 (čl. 35 NTA Urbanističkog plana Općine Santa Teresa Gallura) i u svakom slučaju područje je podložno parcelaciji s ograničenjima i urbanističkim uvjetima koji proizlaze iz primjene norme koja se odnosi na podzonu C1.10.
Stečajni upravitelj zadržava pravo primati i ocjenjivati ponude niže od navedene početne cijene do 25%.
Te ponude će se ocjenjivati samo nakon završetka ove dražbe prema diskrecionom pravu tijela postupka, isključivo u odsutnosti neodgovornih ponuda u iznosu jednakom ili višem od početne cijene.
Kako bi se podnijela ponuda pod upravo opisanim uvjetima, eventualni zainteresirani NE trebaju slijediti postupak "DOVRŠETAK PONUDA PO POČETNOJ CIJENI DRAŽBE", već su dužni poslati zahtjev na adresu pec [email protected] kako bi saznali uvjete podnošenja i primili odgovarajući obrazac ponude.
U svakom slučaju, neodgovorne ponude za kupnju podnesene na temelju gore navedenih uvjeta bit će podložne primjeni Naknade kupca uz zakonski PDV, kao što je navedeno u općim i posebnim uvjetima i u pratećem obavještenju o prodaji.
