Deposit
The present auction is subject to a deposit of

Lots Availability
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on Procedure's expenses.
Property transfer
The transfer of ownership will take place only after full payment of the hammer price, expenses and Buyer's Premium by notarial deed with Notary with Studio in the Province of Trento chosen by the Mandator
Payment deadline
Awarded lots have to be paid in full within 60 days from the provisional awarding.
Buyer's premium due (plus VAT) has to be paid within 15 days from awarding.
Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid in full within 60 days from the provisional awarding.
Buyer's Premium:
A percentage % charge + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law).
The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.
VAT:
VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)
In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
Отмечается, что недвижимость продается в целом, учитывая, что был заключен предварительный договор купли-продажи от 04/05/2022 года, правильно зарегистрированный, имеющий целью передачу в пользу обанкротившегося общества - уже владеющего долей 1/2 - или третьим лицам, названным для оставшейся доли земель, которая будет передана после аукциона.
Земельные участки площадью 12 425 кв.м. попадают под застройку, названную C3.2 Lu Gialdinu и попадающую в подзону C1.10 (ст. 35 НТА Генерального плана города Санта-Тереза-Галлура) и в любом случае являются зоной подлежащей лотированию с ограничениями и строительными-градостроительными ограничениями, вытекающими из применения соответствующего норматива к подзоне C1.10.
Такие предложения будут рассматриваться только после завершения настоящего аукциона по усмотрению Органов Процедуры, исключительно в отсутствие безотзывных предложений на сумму равную или превышающую базовую цену.
Для того чтобы сделать предложение на описанных условиях, заинтересованные лица НЕ должны следовать процедуре "СОВЕРШЕНСТВОВАНИЕ ПРЕДЛОЖЕНИЙ ПО БАЗОВОЙ ЦЕНЕ АУКЦИОНА", а должны отправить запрос на адрес электронной почты pec [email protected] для получения информации о порядке подачи и получения соответствующей формы предложения.
В любом случае, безотзывные предложения о покупке, сделанные на описанных условиях, будут подвергнуты применению Премии покупателя плюс НДС, как указано в общих и специальных условиях и в приложенном объявлении о продаже.
