The present gathering is subject to a mandatory deposit of 10% of the price offered.

Deposit has to be necessarily credited before the gathering deadline.
 
Deposit will be refunded within 20 days from gathering deadline, with no interests applied.
 
In case of acceptance by the Principals of a specific offer irrevocable purchase, the security deposit will be returned after the buyer will carry out the transfer of ownership of the assets object of the gathering , prior authorisation provided by principals. In this case, the deposit will be retained to cover any charges borne by the buyer (see "Documents", but without limitation).
 
If, in the case of awarding ,after paying the deposit, the offer or will not finalize  the purchase within the terms indicated in the section "Payment Terms", apart from agreement  with the principals, the sale will be canceled. The deposit will not be refunded as a penalty for compensation and paid from the agent to the principals as much as 50% within 5 days; the remainder will be retained from the principal as reimbursement of expenses.
 
Participation Rules:
 
 
This is a gathering of irrevocable purchase offers of free amount (for the specification of the exact  appraisal value, published in full in the manner online) for the property described in the APPRAISAL published online.
 
The irrevocable purchase offers gathering on behalf of Principals do not involve any obligation or commitment to sell nor any expense for any mediation or advice outside of this mandate, nor does it constitute invitations to offer, nor offered to the public under art. 1336 c.c., nor public savings solicitations pursuant to art. 94 et seq. of legislative decree. 58/1998. M0019756.
 
The possible sale will take place with obligation and responsibility of the buyer to ascertain their safety compliance.
 
The possibile sale of the assets will be  in fact and law in which they are located, with any appurtenances, accessions, reasons and actions, active and passive servitude as indicated in the attached documentation of the properties. 
 
The possibile sale will be as body and not to measure, and without any warranty for defects or otherlack.
 
Abuse, violations, liens, regulatory compliance
For more information about any abuse, violations, liens or lack of compliance with regulations of the lots subject of the present gathering, please refer to the accompanying expertise and its property sheet.
 
The gathering  will be done using the following modes:
 
All bidders, except the subjects by law not allowed to take part in the gathering, after having joined the site www.gobid.it, will fill in the participation form (published online) and send it undersigned for acceptance of the conditions proposed, at the following address:

Offers must contain:
 
 
-       the exact identification of the tenderer, complete with an indication of the General information and the extremes of an identification document, the tax code and, in the case of a married person, the matrimonial property between the spouses;
 
-       document of the CHAMBER of COMMERCE (Visura CCIAA) and the holder's identification if it  is an individual company or of the legal representative in the case of a legal person.
 
 
- the price offered for Real Estate portion, inclusive of the amount due to the Agent (see Buyer's Premium);

- a fixed and irrevocable offer for at least 90 days to buy the indicated lot at the price offered and to take part at the possible competitive procedure between bidders identified by principal;

- proof of deposit in the amount of 10% of price offered as deposit, credit to current account indicated by agent, contextually at dispatch of irrevocable purchase offer. To the purpose will be necessary sending the accounting of bank transfer certifying the caution money deposit.



In any of the chosen exectution modes, the potential buyers must agree to terms and conditions of use of the platform and terms and conditions of use of the gathering, as stated in the present document.

Conditions of competitive procedure

In the event that the Principal individuals more offers collected by the Agent and appreciated by the Principal himself, will be issued between these suppliers a competitive process in the form of tender to re-launch to be held through the online platform GoBid.it starting from maximum offer received between chooseds.

The above competitive procedure will be managed by the Agent and will last on 7 days.

The Agent will be inform the tenderers identified by the Principal of conditions for the competitive procedure.

Each participant can make free raises from the highest offer among those selected by the Principal; the raises will be public and the Agent will keep constantly informed the participants of the trend of auction.

Lots sale modes

At the end of the competitive process it will be identified the contractor of the lot, object of the competitive process itself, in the competitor who will place the highest financial offer. In the event that during the competitive procedure offers will not be made by the participants, the contractor will be the person who, between those selected by the Principal and admitted to the competitive process, made the highest offer at time of collection of offerings.

Identified the contractors of each of lots for sale, the same one will also have to pay the Principal the amount due by bank transfer - or by cashier's check at Principal’s discretion - within 30 days from awarding, and in any case no later than expected date for deed, under pain of awarding cancellation and permanent loss of deposit paid.

In the event that the contractor will not pay the price due for the lot within the deadline, the Principal reserves the right to confer the awarding, in case exist, to the next highest bidder.

The notary fees, tax law and all expenses related to sale, fiscal and non fiscal, will be on buyer’s expense.
The contractor will provide for the payment of these fees within 30 days from the date of the hammer price, and in any case no later than the date of the deed.

The buyer's premium will have to be paid by the contractor in favor of Agent contextually with the payment of the purchase of the lot.

Property transfer will occur after the full payment of awarding price and all expenses due in the modes indicated by the Principal. After payments deadline  , in case of lack property transfer finalization, the sale will be canceled and the amount paid by the user who awarded the lot as Buyer's Premium will not be refunded, as a penalty.

Communications


At the end of each gathering, the agent will send a specific communication to the interested subjects and to the Principals, who will be called upon to decide, at their sole discretion, on the final result of the irrevocable purchase offers.


Buyer's Premium


The bonus of Agent (indicated by the words "buyer's premium") will be on buyer’s expense.

The Buyer's Premium will be due for each lot awarded , with Principal approval, and will be calculated with a percentage on the final hammer price with a progressive percentage for classes in the amount of:

- 5% until appraisal price;
- 10% for the portion of the price exceeding the appraisal price




VAT


22.00% VAT of the awarding price will be calculated on the hammer price of each lot and on the related Buyer's Premium due. (where applicable)


Language


In case of insurgency of any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website translated in different languages, it will be applied the Italian language version of such texts
