The present gathering is subject to a mandatory deposit of EUR 157.000,00.

Deposit has to be necessarily credited before the 
gathering deadline.
In the event of a final awarding, deposit will be retained as an advance payment and charged to price account at the time of property transfer.

Participation Rules:

The gathering will be done using the following modes:

All bidders, except the subjects by law not allowed to take part in the gathering, after having joined the site www.gorealbid.it, will be required to send an irrevocable purchase offer at a free amount, trough compilation of offer form (published online) and send it undersigned for acceptance of the conditions proposed, at the following address:

in conjunction with the copy proof of the Bank confirming payment of the warranty deposit required.

Irrevocable purchase offers presenting by potential buyers must be accompanied by payment of securety deposit required, the payment of which will constitute, in itself, a formal commitment to purchase by the underwriter of each offer.
 

Best offer received at certified email address provided by agent may be used as an auction base price for a competitive sales experiment to be conducted on Platform.
 
Agent will be responsible for informing all tenderers in any way whether they are or not best bidders when formalizing the above-mentioned irrevocable purchase offer.
 
Principal reserves, at its sole discretion, the right to accept or not irrevocable purchase offers submitted by potential buyers.
 
In the event of acceptance of the best offer, Principal will appoint agent at next sale, to be auctioned online on the basis of best offer received and whose specific terms are shown below. 

The offers must be formulated according to the methods indicated in the attached notice of sale.

Filling out the form will result in acceptance of the conditions of use of the www.gorealbid.it platform and the general and specific terms of the collection and any subsequent auction as well as all the forecasts indicated in the notice of sale.


Particular Conditions

According to the art. 105, second paragraph of the Bankruptcy Law, which refers to art. 2556 Civil Code, the sale will be completed by notarial deed at the buyer's expense.
 
The sale will be subject to the taxes provided for by the relevant law.

 

Lots Availability
 
Any registration related to preemption rights, registration of foreclosures and seizes, or any other tie falling on the lots on sale will be cancelled complying to art. 108 Bankruptcy Law (Legge Fallimentare) once the sale will be completed and the price will be fully collected. Any formalities for cancellation will be on buyer's expenses.


Payment Methods

All payments have to be made exclusively by bank transfer. Account details will be indicated whether at the time of registration or  in conjunction with the awarding statement (in a private message to the user mailbox). (see General Terms and Conditions)


Payment deadline

Awarding lots have to be paid not later than date set for property transfer.

Buyer's Premium have to be paid within 15 days from awarding.


Fees and expenses related to sale on buyer's expense (law fees, notarial fees, fiscal and non fiscal fees) have to be paid within 30 days from awarding and in any case no later than date for property transfer.

Property transfer

Property transfer will occur after the full payment of awarding price and all expenses due by notarial deed in the modes indicated by the Principal, and in any case not later than 60 days from provisional awarding.

The principal  will communicate Delegate Judge to operate for the cancellation of prejudicial registration on the property goods subject of sale complying to art 108 bankruptcy law.

In case of lack property transfer finalization, the sale will be canceled and the amount paid by the user who awarded the lot as Buyer's Premium will not be refunded, as a penalty.
 

Buyer's Premium

 
A percentage of 1,00% charge  + VAT will be added to the price of each awarded lot also in case of offers received related to art. 107 L.F (Bankruptcy Law). 

The above mentioned percentage charge will be applied according to the modes shown in the following table:

The calculation base of Buyer's Premium is divided into different staggers each one corresponding to a rate decreasing when staggers increase.

 
For each awarding price, the corresponding Buyers' Premium will be given by the sum of the commissions calculated on the referring stagger, according to the modes indicated in the table above.


VAT on lot: 

VAT application may vary according to law depending on the awarding subject and will be calculated on the awarding price and added to it. (where applicable)


In case of insurgency of  any controversy related to the interpretation of the dispositions included in the general and specific terms present in the website  translated in different languages, it will be applied the Italian language version of such texts



It should be noted that there is a company lease contract with expiry in 25/08/2023 at a monthly fee of € 10,000.

All credits and debts of the bankrupt company as well as those accrued during the phase following the declaration of bankruptcy are excluded from the sale and will remain the responsibility of the procedure, pursuant to articles 105 and following of the L.F.
The successful bidder will have the right to make the payment of the price also by taking over the debt for the severance pay accrued by the workers employed by the company at the time of the leasing of the same, provided that the release of the procedure by the workers.
