Collection of awarded lots

The purchaser may collect the awarded lots only after payment of the purchase price and the applicable commissions (Buyer's Premium and additional management charges) has actually been received.

In any event, collection must be completed no later than 30 days after the provisional award.

To optimise the collection service, GOBID INTERNATIONAL AUCTION GROUP SRL will notify successful bidders by email of the date(s) and time during which they may collect the lots. These dates may also be indicated on the auction webpage. In any event, GOBID INTERNATIONAL AUCTION GROUP SRL reserves the right to change the indicated collection dates and times at its sole discretion.

If the successful bidder collects the lots on dates other than those communicated, they must pay an additional fee of between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of goods to be collected.

Successful bidders must comply with the start date of the collection operations. If the successful bidder is unable to collect the lots on the communicated date and time, they may:

-  subject to approval, request permission to attend on the date(s) scheduled for the next sale attempt, if applicable.

-  subject to approval, collect the lots on days and at times other than those made available for the individual sale attempt, by paying an additional fee of between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of goods to be collected

Failure to comply with the collection date scheduled between GOBID INTERNATIONAL AUCTION GROUP SRL and the successful bidder will result in a penalty of EUR 350.00 being charged to the successful bidder if the failure to collect is not notified at least 48 hours before the appointment, without prejudice, in any event, to GOBID INTERNATIONAL AUCTION GROUP SRL's right to compensation for any greater loss suffered.

All lots not collected by the deadline stated above will incur a daily late fee of EUR 50.00. If the goods are not collected within 30 days of the collection deadline, the sale will automatically be deemed terminated and the amounts paid by the successful bidder (awarded lots, Buyer's Premium, additional management charges and any additional fees paid) will be retained as compensation by way of penalty.

GOBID INTERNATIONAL AUCTION GROUP SRL is not required to deliver any lot or to make any arrangements for their collection.

Collection operations must be carried out by the purchaser in compliance with the applicable statutory safety regulations. The purchaser is therefore required to make any necessary adjustments in this regard, including with respect to any third parties and/or collaborators engaged in carrying out the aforementioned operations.

The purchaser is responsible for any dismantling, handling, loading and transport of the awarded lots and must leave the areas where collection took place in a safe condition and clear of any goods and/or waste materials generated by them during the aforementioned operations. In the case of registered movable assets, the purchaser is responsible for completing the procedures required to carry out the necessary transfers of ownership.

Transfers of ownership must therefore be carried out at the successful bidder's expense through the vehicle registration agency indicated by the bodies managing the proceedings or, alternatively, by GOBID INTERNATIONAL AUCTION GROUP SRL.

The Buyer's Premium will have a minimum amount of €25 (+ 22% VAT where applicable) for each lot or combination awarded, as a minimum commission.

Additional management fees: These are additional costs borne entirely by the successful bidder, intended to cover the services and activities, performed and to be performed, necessary for preparing, organizing and managing the sale of the goods at auction and the subsequent award phase. These costs must be paid at the same time as the Buyer's Premium due, as stated in the provisional award confirmation issued after the auction closes. Where applicable, these fees will be indicated in each lot's description.

VAT: VAT at 22,00% of the sale price will be calculated on the hammer price of each lot (where applicable).

Extra-Time: if a winning bid is placed within the 5 minutes preceding the auction's closing, the time available to place another bid will be extended by a further 5 minutes from the last bid received. This extension will continue indefinitely; for each winning bid received within the 5-minute extra-time period, the time available to place another bid will be extended by a further 5 minutes from the last bid received.  Automatic bids placed in response to a maximum bid (proxy bids) will also be considered winning bids.

If bids are received for the entire lot (Lot 0), at the end of the auction the bodies responsible for the proceedings reserve the right to decide whether or not to award this lot, based on the prices reached for the individual lots.

Lots are sold as seen and accepted in their current condition. Inspection is recommended.

Any modifications required to bring the goods into compliance with all applicable regulations, particularly those concerning accident prevention and safety, as well as environmental protection and, more generally, current regulations, shall be the sole responsibility of the purchaser, who shall bear all related costs, with the seller exempt from any liability in this regard. Any equipment that does not comply with the regulations currently in force, if included in the inventory, shall be deemed to be offered for sale solely as a source of spare parts, and the Receivership shall bear no liability for any use thereof by the transferee. The sale of the goods is a forced sale (Art. 2919 of the Civil Code) and is conducted on the basis that the goods are sold as seen and accepted in the factual and legal condition in which they are found. In a forced sale, there is no warranty against defects in the goods. The sale may not be challenged on the grounds of damage (Art. 2922 of the Civil Code).

The Agent shall have no liability whatsoever with regard to the existence of third-party rights over goods offered for sale (Art. 2920 of the Civil Code).

The sale is made on the condition that the successful bidder is responsible for verifying that the goods comply with safety regulations.
