By submitting a bid, the bidder declares that they have read and fully accept these terms of sale and all documentation made available. If a notice of sale is attached to the auction listing/announcement, by submitting a bid the bidder declares that they have read and accept the conditions set out therein, of which these terms of sale are to be understood as an extract. Deposit

The auction is subject to a security deposit of EUR 3.000,00.

The security deposit must be paid by:

The security deposit must be credited before the auction ends.
Once the security deposit has been credited, the user will be authorized to participate in the auction.
To expedite participation in the auction, users are advised to email a scanned copy of the payment receipt showing the CRO code to: [email protected]

If auction participants do not win any lots, the security deposit will be refunded within 20 working days of the auction closing date, without interest.

If, after paying the security deposit and winning a lot, the bidder fails to complete the purchase, the security deposit will be retained.

Availability of Lots

Any registrations relating to pre-emption rights, entries of attachments and precautionary seizures, and any other encumbrances on the assets offered for sale will be cancelled pursuant to Article 217, paragraph 2 of the C.C.I.I. once the sale has been completed and the price has been paid in full. All formalities for cancellation shall be carried out at the buyer's expense and responsibility.

All costs relating to transfers of ownership, including any successive transfers and related charges, shall be borne by the buyer

If registered movable assets are exported, the buyer must carry out the required procedures in accordance with applicable laws. Please note that, for the purpose of deregistration for export, vehicles must be compliant with statutory inspection requirements as of the date of the request.

Payment method

All payments must be made exclusively by bank transfer. The details will be provided either at the time of registration or when the user receives the notification that they have won (see general terms and conditions).

Payment deadline

Winning bids must be paid within 5 days of confirmation of the winning bid.
The Buyer's Premium and any additional management fees, where applicable, must be paid within 5 days of confirmation of the winning bid.

Collection of Lots Won
 
The buyer may collect the lots won only after the payments of the winning bid price and the applicable commissions (Buyer's Premium, additional management fees) have actually been received.
 
In all cases, collection must be completed no later than 30 days from the date the lot is won.
 
To optimize the collection service, GOBID INTERNATIONAL AUCTION GROUP SRL will notify successful bidders by email of the date(s) and time slot during which they may collect the lots. These dates may also be indicated on the auction webpage. In any event, GOBID INTERNATIONAL AUCTION GROUP SRL reserves the right to change the stated collection dates and times at its sole discretion.
 
If the successful bidder collects the lots on dates other than those communicated, they must pay an additional fee of between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of goods to be collected.
 
Successful bidders must comply with the start date of collection operations. If a successful bidder is unable to collect on the communicated date and time, they may:
 
-  subject to approval, request permission to attend on the date(s) scheduled for the next sale, if applicable.
 
-  subject to approval, collect on days and at times other than those made available for the individual sale, by paying an additional fee of between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of goods to be collected
 
Failure to comply with the collection date scheduled between GOBID INTERNATIONAL AUCTION GROUP SRL and the successful bidder will result in a penalty of EUR 350.00 being charged to the successful bidder if the failure to collect is not reported at least 48 hours before the appointment, without prejudice, in any event, to GOBID INTERNATIONAL AUCTION GROUP SRL's right to compensation for any greater loss suffered.
 
All lots not collected by the above deadline will be subject to a daily late fee of EUR 50.00. If the goods are not collected within 30 days of the collection deadline, the sale will be automatically terminated and the amounts paid by the successful bidder (winning bids, Buyer's Premium, additional management fees and any additional fees paid) will be retained as compensation by way of a penalty. 
 
GOBID INTERNATIONAL AUCTION GROUP SRL is not required to deliver any lot or to make any arrangements for their collection. 
 
Collection operations must be carried out by the buyer in compliance with the applicable safety regulations; the buyer is therefore required to make any necessary adjustments in this regard, including with respect to any third parties and/or contractors engaged in carrying out these operations.
 
The buyer is responsible for any dismantling, handling, loading and transportation of the lots won and must leave the collection area safe and free of any goods and/or waste materials generated during the aforementioned operations. In the case of registered movable assets, the buyer is responsible for completing the procedures required to carry out the necessary transfers of ownership. 
 
Transfers of ownership must therefore be carried out at the buyer's expense and responsibility through the vehicle registration agency designated by the authorities responsible for the proceedings or, alternatively, by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
If registered movable assets are exported, the buyer must carry out the required procedures in accordance with applicable laws.
 
In all cases, GOBID INTERNATIONAL AUCTION GROUP SRL will not release any lot until the aforementioned payments have been credited and, in the case of registered movable assets, until the relevant transfer of ownership has been completed.
Other specific conditions

Buyer's Premium: A charge of 15,00% + VAT will be added to the hammer price of each lot.

The Buyer's Premium will be subject to a minimum amount of €25 (+ 22% VAT where applicable) for each lot or combination of lots awarded, as a minimum fee.

Additional handling charges: These are additional costs borne entirely by the successful bidder, intended to cover the services and activities, performed and to be performed, necessary for the preparation, organisation and management of the sale of the assets at auction and the subsequent award process. These costs must be paid at the same time as the Buyer's Premium due, as stated in the confirmation of award, which will be issued after the auction closes. Where applicable, these charges will be indicated in the details for each lot.

VAT: VAT at 22,00% of the sale price will be calculated on the hammer price of each lot (where applicable).

Extra-Time: if a winning bid is placed within the 5 minutes preceding the close of the auction, the time available to place another bid will be extended by a further 5 minutes from the last bid received. This will continue indefinitely: for every winning bid received within the 5-minute extra-time period, the time available to place another bid will be extended by a further 5 minutes from the last bid received.  Automatic bids placed when a maximum bid is set (proxy bids) will also be considered winning bids.

Lots are sold as seen and accepted in their current condition. Inspection is recommended.

Any adaptations of the assets to comply with all applicable regulations, and in particular those concerning prevention and safety, as well as those relating to ecological and environmental protection and, more generally, applicable regulations, shall be the exclusive responsibility of the purchaser, who shall bear all related costs, with the seller released from any liability in this respect. Any capital goods that do not comply with the regulations currently in force, if included in the inventory, shall be considered to have been sold solely as spare parts, and the Receivership shall bear no liability if they are used by the transferee. In particular, for any assets that do not comply with safety regulations and lack the CE marking, the successful bidder must, at their own sole expense and risk, bring them into compliance or, if this is not possible, dispose of them in accordance with the law.

The sale of the assets is a forced sale (Art. 2919 of the Italian Civil Code) and is conducted on the basis that the assets are sold as seen and accepted in their actual and legal condition. In a forced sale, no warranty is given for defects in the item. The sale may not be challenged on grounds of damage (Art. 2922 of the Italian Civil Code).

Consequently, the existence of any defects, lack of quality or non-conformity in the item sold shall not give rise to compensation, indemnity or a reduction in the price.

The Agent shall have no liability whatsoever with regard to the existence of third-party rights over assets offered for sale (Art. 2920 of the Italian Civil Code).

The sale is made subject to the successful bidder's obligation and responsibility to verify that the assets comply with safety regulations.

In the event of any disputes concerning the interpretation of the provisions contained in the general and specific conditions set out on the platform, which may have been translated into other languages, the Italian version of the text shall prevail.
