By submitting a bid, the bidder declares that they have fully read and accept these terms of sale and all documentation made available. If a notice of sale is attached to the auction sheet/listing, by placing a bid the bidder declares that they have read and accept the conditions set out therein, of which these terms of sale are to be considered an extract. The bidder also declares that they have examined and accepted all documentation made available for the purposes of participating

Deposit

The auction is subject to a security deposit of EUR 300,00.

The deposit must be credited before the auction closes.
Once the deposit has been credited, the user will be enabled to participate in the auction.
To speed up participation in the auction, users are advised to send a scanned copy of the payment receipt showing the CRO code to: [email protected]

If participants do not win any lots at the auction, the deposit will be refunded within 20 working days of the auction closing date, without interest.

If, after winning a lot and paying the deposit, the bidder does not complete the purchase, the deposit will be retained.

Availability of Lots

Any registrations relating to pre-emption rights, entries of attachments and conservatory seizures, and any other encumbrances on the assets offered for sale, will be cancelled pursuant to Art. 217, paragraph 2, of the C.C.I.I. once the sale has been completed and the full price has been collected. All formalities for cancellation shall be carried out at the successful bidder's expense.

All costs relating to transfers of ownership, including any double transfers and related charges, shall be borne by the successful bidder

In the event of the export of registered movable assets, the buyer must carry out the required procedures in compliance with applicable law. Please note that, for the purposes of deregistration for export, vehicles must be compliant with legally required inspection obligations as of the date of the request.

Payment method

All payments must be made exclusively by bank transfer. The bank details will be provided either upon registration or when the user receives notification that they have won a lot (see general terms and conditions).

Payment deadline

Lots won must be paid for within 5 days of confirmation of the provisional award.
The Buyer's Premium and any additional management charges, where applicable, must be paid within 5 days of confirmation of the provisional award.

Collection of lots won
 
The buyer may collect the lots won only after payment of the winning price and the applicable commissions (Buyer's Premium, additional management charges) has actually been received.
 
In all cases, collection must be completed no later than 30 days after the provisional award.
 
To facilitate the collection service, GOBID INTERNATIONAL AUCTION GROUP SRL will notify successful bidders by email of the date(s) and time during which they may collect the lots. These dates may also be indicated on the auction webpage. In any event, GOBID INTERNATIONAL AUCTION GROUP SRL reserves the right to change the stated collection dates and times at its sole discretion.
 
If the successful bidder collects the lots on dates other than those notified, they must pay an additional fee of between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of goods to be collected.
 
Successful bidders must comply with the start date of the collection operations. If the successful bidder is unable to collect on the notified date and time, they may:
 
-  subject to approval, request permission to attend during the date(s) scheduled for the next sale, if applicable.
 
-  subject to approval, collect on days and at times other than those made available for the individual sale, by paying an additional fee of between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of goods to be collected
 
Failure to comply with the collection date scheduled between GOBID INTERNATIONAL AUCTION GROUP SRL and the successful bidder will result in a penalty of EUR 350.00 being charged to the successful bidder if the failure to collect is not notified at least 48 hours before the appointment, without prejudice, in any event, to GOBID INTERNATIONAL AUCTION GROUP SRL's right to compensation for any greater loss suffered.
 
All lots not collected by the deadline stated above will incur a daily late fee of EUR 50.00. If the asset is not collected within 30 days of the collection deadline, the sale will be automatically terminated and the amounts paid by the successful bidder (lots won, Buyer's Premium, additional management charges and any additional fees paid) will be retained as liquidated damages. 
 
GOBID INTERNATIONAL AUCTION GROUP SRL is not required to deliver any lot or to make any arrangements for their collection. 
 
The buyer must carry out collection operations in compliance with the safety regulations in force; the buyer must therefore make any necessary adjustments in this regard, including with respect to any third parties and/or contractors engaged in carrying out those operations.
 
The buyer is responsible for any dismantling, handling, loading and transportation of the lots won and must leave the premises where collection takes place in a safe condition and free of any goods and/or waste materials generated by the buyer during the above operations. In the case of registered movable assets, the buyer is responsible for completing the procedures required to carry out the necessary transfers of ownership. 
 
Transfers of ownership must therefore be carried out at the successful bidder's expense through the vehicle-registration agency notified by the bodies administering the proceedings or, alternatively, by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
In the event of the export of registered movable assets, the buyer must carry out the required procedures in compliance with applicable law.
 
In all cases, GOBID INTERNATIONAL AUCTION GROUP SRL will not release any lot until the above payments have been credited and, in the case of registered movable assets, until the relevant transfer of ownership has been completed.
Other Specific Conditions

Buyer's Premium: A charge of 15,00% + VAT will be added to the hammer price of each lot.

The Buyer’s Premium shall be subject to a minimum amount of €25 (+ 22% VAT where applicable) for each lot or combination of lots awarded, as a minimum fee.

Ancillary management charges: These are ancillary costs borne entirely by the successful bidder, intended to cover the services and activities, performed and to be performed, necessary for the preparation, organisation and management of the sale of the goods at auction and the subsequent award phase. These expenses must be paid at the same time as the buyer's premium due, as stated in the provisional award confirmation, which will be issued after the auction has ended. Where applicable, these charges will be indicated in each lot's description.

VAT: VAT at 22,00% of the sale price will be calculated on the hammer price of each lot (where applicable).
The procedure is not registered with VIES. VAT will therefore also be due from intra-Community purchasers.

Extra Time: if a winning bid is placed within the 5 minutes before the auction closes, the time available to place another bid will be extended by a further 5 minutes from the last bid received. This will continue indefinitely: for each winning bid received within the 5-minute extra-time period, the time available to place another bid will be extended by a further 5 minutes from the last bid received.  Automatic bids placed when a maximum bid (proxy bid) is in effect will also be considered winning bids.

Lots are sold as seen and accepted in their current condition. Inspection is recommended.

The sale of the goods is deemed to be a forced sale (Art. 2919 of the Italian Civil Code); the goods are sold as seen and accepted in the factual and legal condition in which they are found. In a forced sale, there is no warranty against defects in the item. The sale may not be challenged on grounds of damage (Art. 2922 of the Italian Civil Code).

Consequently, the existence of any defects, lack of quality or non-conformity in the item sold shall not give rise to compensation, indemnity or a reduction in price.

The Agent shall have no liability whatsoever with regard to the existence of third-party rights over goods offered for sale (Art. 2920 of the Italian Civil Code).

The sale is subject to the successful bidder's obligation and responsibility to verify that the goods comply with safety regulations.

In the event of any disputes concerning the interpretation of the provisions contained in the general and specific conditions set out on the platform, which may have been translated into other languages, the Italian version of the text shall prevail.
