Collection of lots won

The buyer may collect the lots won only after payment of the winning bid price and the applicable commissions (Buyer’s Premium, additional management charges) has actually been received.

In any event, collection must be completed no later than 30 days from the provisional award.

To optimise the collection service, GOBID INTERNATIONAL AUCTION GROUP SRL will notify successful bidders by email of the date(s) and time during which they may collect the lots. These dates may also be indicated on the auction webpage. In any event, GOBID INTERNATIONAL AUCTION GROUP SRL reserves the right to change the stated collection dates and times at its sole discretion.

If the successful bidder collects the lots on dates other than those communicated, they must pay an additional charge of between EUR 250.00 and EUR 350.00, plus VAT, per day, depending on the quantity of goods to be collected.

Successful bidders must comply with the start date of the collection operations. If the successful bidder is unable to collect the lots on the communicated date and time, they may:

-  subject to approval, request permission to attend during the date(s) scheduled for the next sale, if applicable.

-  subject to approval, collect the lots on days and at times other than those made available for the individual sale, by paying an additional charge of between EUR 250.00 and EUR 350.00, plus VAT, per day, depending on the quantity of goods to be collected

Failure to comply with the collection date scheduled between GOBID INTERNATIONAL AUCTION GROUP SRL and the successful bidder will result in a penalty of EUR 350.00 being charged to the successful bidder if the failure to collect is not notified at least 48 hours before the appointment, without prejudice, in any event, to GOBID INTERNATIONAL AUCTION GROUP SRL's right to claim compensation for any greater loss suffered.

All lots not collected within the deadline specified above will incur a daily late fee of EUR 50.00. If the goods are not collected within 30 days of the collection deadline, the sale will be automatically terminated and the amounts paid by the successful bidder (lots won, Buyer’s Premium, additional management charges and any additional charges paid) will be retained as compensation by way of a penalty.

GOBID INTERNATIONAL AUCTION GROUP SRL is not required to deliver any lots or to arrange their collection in any way.

The buyer must carry out the collection operations in compliance with the applicable statutory safety regulations; they are therefore required to implement the necessary measures in this regard, including with respect to any third parties and/or contractors engaged in carrying out these operations.

The buyer is responsible for any disassembly, handling, loading and transportation of the lots won and must leave the areas affected by the collection in a safe condition and free of any goods and/or waste materials they have generated during the aforementioned operations. For registered movable assets, the buyer is responsible for completing the procedures required to carry out the necessary transfers of ownership.

Transfers of ownership must therefore be carried out at the successful bidder’s expense through the vehicle registration agency notified by the authorities responsible for the proceedings or, alternatively, by GOBID INTERNATIONAL AUCTION GROUP SRL.

If registered movable assets are exported, the buyer must carry out the required procedures in compliance with the applicable regulations.

In any event, GOBID INTERNATIONAL AUCTION GROUP SRL will not release any lot until the above payments have been credited and, in the case of registered movable assets, until the relevant transfer of ownership has been completed.

Other specific conditions

Buyer's Premium
: A charge of 15,00% + VAT will be added to the hammer price of each lot.

The Buyer's Premium will be subject to a minimum amount of €25 (+ 22% VAT where applicable) for each lot or combination won, as a minimum commission.

Additional management charges: These are additional costs borne entirely by the successful bidder, intended to cover the services and activities, performed and to be performed, required for the preparation, organisation and management of the sale of the auction goods and the subsequent award phase. These expenses must be paid at the same time as the buyer's premium due, as stated in the provisional award confirmation that will be issued after the auction ends. Where applicable, these charges will be indicated in the description of each lot.

VAT: VAT at 22,00% of the sale price will be calculated on the hammer price of each lot (where applicable).

Extra Time: if a winning bid is placed in the 5 minutes before the auction closes, the time available to place another bid will be extended by a further 5 minutes from the last bid received. This process will continue indefinitely: for each winning bid received within the 5-minute extra-time period, the time available to place another bid will be extended by a further 5 minutes from the last bid received.  Automatic bids placed when a maximum bid (proxy bid) is set will also be considered winning bids.

Lots are sold as seen and accepted in their current condition. Inspection is recommended.

The sale of the goods is deemed to be a forced sale (Art. 2919 of the Italian Civil Code); the goods are sold as seen and accepted in their actual and legal condition. In a forced sale, no warranty is provided for defects in the item. The sale may not be challenged on grounds of damage (Art. 2922 of the Italian Civil Code).

Accordingly, the existence of any defects, lack of quality or non-conformity in the item sold shall not give rise to compensation, indemnity or a reduction in the price.

The Agent shall bear no liability whatsoever with regard to the existence of third-party rights over the goods being sold (Art. 2920 of the Italian Civil Code).

The sale is made on the condition that the successful bidder is responsible for and bears the costs of verifying the goods' compliance with safety regulations.

In the event of any disputes concerning the interpretation of the provisions contained in the general and specific terms and conditions displayed on the platform, which may have been translated into other languages, the Italian version of the text shall prevail.
