Conditions for visiting the lots

Deposit

To participate in the Auction, it is necessary to pay the deposit indicated in the file for each lot.

The deposit must be made by bank transfer to the account expressed below:

Concept: auction number and lot number

Interested users must deposit the deposit described above before the end of the Auction.
Only once the deposit has been received will the user be authorized to participate in the Auction.

To expedite participation in the auction, it is recommended to send the proof of payment to [email protected]

Users who have participated in the Auction but have not been awarded any goods will receive their deposit back within 20 business days following the conclusion of the auction, without interest.

If, after having made the deposit and having been awarded the lot for sale, the bidder does not complete the acquisition by paying the sale price and the Buyer's Premium, said deposit will be retained, without prejudice to the compensation for damages that could be claimed.

In this case, the award will not be assigned to the next highest bidder, but a new auction with free competition will be held for a period of 15 days, in accordance with the special liquidation rules, which will be notified to non-awarded bidders.

Charges

The sale of the goods is made free of charges and encumbrances.
All taxes, fees and duties that are legally applicable relating to the award or sale or transfer of each asset will be for the account and at the expense of the awardees or buyers. In the event that the vehicles have municipal IVTM taxes pending payment, these will be at the expense of the awardee.

Award of the lots

The sale will be made without being subject to a minimum price, although the Insolvency Administration reserves the right to reject the best offers if it considers them insufficient or not suitable for the interests of the insolvency proceeding. For accepted offers, the specialized entity will send the provisional award confirmation to the awardee, who will be obliged to make the payment of the offered amount.

Warning: the Insolvency Administration reserves the possibility of communicating the winning offer to the Court for its approval. In this case, only once the offer has been approved by the Court, the award confirmation will be sent to the highest bidder with the instructions to make the payments within the established deadlines.

Payment method

All payments must be made entirely by bank transfer using the accounts communicated at the time of registration or together with the award communication (see general auction conditions). The award price will be paid into the account of the insolvent company, which will be indicated in the award communication; the Buyer's Premium will be paid into the account of GOBID ESPAÑA S.L.

Payment deadline

The payment of the award price for the lots must be made within 20 days from the award communication.
The payment of the Buyer's Premium must be made within 10 days from the award communication.

Conditions for collection

In any case, the collection must be completed no later than 20 days from the provisional award confirmation.

In order to optimize the collection service, GOBID ESPAÑA S.L. will communicate by email to the awardees the date and time to proceed with the collection of the lots. These dates may also be indicated on the auction website. In any case, GOBID ESPAÑA S.L. reserves the right to change the dates and times indicated for collection at its sole discretion.

In the event that the awardee has to carry out the collection on additional dates to those offered, they will have to pay an amount between EUR 250.00 and EUR 350.00 plus VAT for each additional day, depending on the goods to be collected, as additional expenses.

The awardees must respect the proposed date. In the event that they cannot carry out the collection on the communicated date and time, they may:

- with prior approval, request that the collection be admitted in the next sale phase, if scheduled.
- with prior approval, carry out the collection on days and times different from those initially proposed in the same sale phase, paying an additional fee of between 250.00 euros and 350.00 euros plus VAT per additional day and person necessary for assistance, as additional expenses.

Failure to comply with the scheduled collection date between GOBID ESPAÑA S.L. and the awardee will result in the application of a penalty to the latter of 350.00 euros if they have not notified the cancellation of the collection at least 48 hours before the appointment, without prejudice to the fact that, in any case, compensation for damages must be paid to GOBID ESPAÑA S.L.

Lots that have not been collected within the established period will be subject to a daily penalty of 50.00 euros. In the event that the goods are not collected within 30 days following the last day provided for collection, the sale will be considered resolved and the amounts paid by the awardee will be retained (Awarded lots – Buyer's Premium, complementary management expenses and any complementary charges paid), as compensation for the damage caused.

GOBID ESPAÑA S.L. has no obligation to deliver any lot or to organize in any way the collection and delivery thereof.

The collection operations must be carried out by the buyer in compliance with the current safety regulations established by law; therefore, they will be obliged to make the necessary adjustments even when they refer to third parties and/or collaborators employed in carrying out the aforementioned operations.

The awardee is responsible for the eventual disassembly, movement, loading and transport of the awarded lots and, in the case of vehicles, also for the transfer of ownership and other corresponding procedures.

In any case, GOBID ESPAÑA S.L. will not make any lot available before the previous payments have been paid and, in the case of registered movable property, before the corresponding transfer of ownership is completed.

Other specific conditions

Buyer's Premium: a charge of 5.00% (plus 21% VAT, if applicable) of the award price of each lot, which will be added to it.
The Buyer's Premium will have a minimum amount of 50 euros (plus 21.00% VAT, if applicable) for each lot or combination awarded (minimum commission).

Administration expenses: these are additional expenses that fall entirely on the awardee, intended to cover the services and activities, carried out and to be carried out, necessary for the preparation, organization and management of the sale of the goods at auction and the post-award phase. These expenses must be paid together with the payment of the Buyer's Premium, according to the provisional award confirmation that will be issued once the auction has ended. Their amount is indicated in the file for each lot.

VAT: VAT of 21.00% of the sale price, which will be calculated on the award price of each lot (if applicable).

Offers for the Complete Lot (Lot 0): in the event that no offers are received for Lot 0, the award of the individual lots that have received bids, according to the provisions of the section «Award of lots». In the event that bids are received both for Lot 0 and for the individual lots, the Insolvency Administration, at the end of the auction, will decide whether to award Lot 0 or the individual lots, based on the values reached.

Formatting of computer equipment (Lot 4): the successful bidder must format the equipment that requires it before removal, at their expense, and certify that they have been emptied in accordance with current regulations by delivering to GOBID ESPAÑA S.L. the corresponding secure erasure certificate.

Decontamination and transport of equipment: if any element requires decontamination or securing before removal, such process, as well as disassembly, removal and transport in accordance with current regulations, shall be the responsibility and at the expense of the successful bidder. This includes biological safety cabinets, refrigeration equipment and the transport of liquid nitrogen tanks in accordance with dangerous goods regulations (ADR).

Software and contracts: software licenses, maintenance contracts and manufacturer warranties associated with the equipment are not included in the sale.

Extra-Time: If in the last 5 minutes any user places a bid, the period will be extended by an additional 5 minutes and the countdown will restart and so on until no offer is made in the last 5 minutes of extra-time. In the case of a maximum bid (proxy bid), automatic increments will be considered valid for the extension of the extra-time period.

The sale of the goods will be carried out in accordance with the situation in which they are found, both in terms of their physical configuration and their legal status. Bids made are irrevocable, and the price cannot be revised nor can the sale be withdrawn for any reason. It is advisable to visit the lots for sale.

All expenses caused by the disposal shall be borne by the successful bidder, including removal and transport costs, any property transfer costs, notarial deed and the eventual cancellation in any public registry of the charges or encumbrances established on them.

No post-sale warranty is applicable for non-conformity of the goods, so it cannot be claimed by any of the purchasers or interested parties.

Therefore, the existence of any damage or lack of quality in the goods sold cannot give rise to any extrajudicial or judicial action for compensation or reimbursement.

Any liability of the Agent regarding the existence of third-party rights over the goods subject to the sale is excluded.

The sale is carried out with the obligation on the part of the buyer to assume their own expenses and responsibility in order to verify their true conformity with the good offered for sale.

Any liability of GOBID ESPAÑA S.L. derived from errors or inaccuracies in the translation of the texts and material published on the website is excluded.
