[email protected].
Creditors with a special privilege over the real estate sold in this auction are exempt from depositing the deposit to bid on the lots over which they hold such credit. To participate in the auction, they must send an email stating their position and submit the documentation required for participation, except for proof of payment of the deposit.
Users who participated in the auction without being awarded any asset will have their deposit returned, without interest, within 20 business days following the conclusion of the auction. The successful bidder will have it returned within 5 business days after the sale is formalized in a public deed, subject to authorization by the Insolvency Administration.
If, after making the deposit and being awarded the lot, the bidder does not complete the acquisition by paying the sale price and the Buyer's Premium, they will lose the deposit, which will be retained as compensation. Half will be transferred to the insolvency estate and the remaining half will be received by the specialized entity as management expenses. In this case, the award will be attributed to the next best bidder who has made a bid equal to or higher than the reserve price; otherwise, it must be approved by the Insolvency Administration.
Charges and encumbrancesThe sale will be made free of charges and encumbrances, except for rights limiting ownership, legal easements and the corresponding urban planning charges.
Taxes, levies and duties relating to the award, sale or transfer of each asset will be for the account and responsibility of the successful bidders or buyers, who will also assume notarial, registry and any other expenses related to the sale, including municipal capital gains tax. In no case will the insolvent company bear any expense derived from the sale. Likewise, any outstanding amounts that may exist as Property Tax, urbanization fees and community expenses, as well as fees and all types of accrued and unpaid expenses of the insolvent company that encumber the assets, will be for the buyer's account.
The Court will only issue the orders for cancellation of charges once the Insolvency Administration certifies the effective transfer of the assets.
The Insolvency Administration will request the Court to cancel the charges and registry annotations, both from attachments and arising from the insolvency proceedings. The resulting expenses will be borne by the acquirer.
Award of the lotsAt the end of the auction, if the winning bid is equal to or higher than the reserve price, the award confirmation will be sent to the best bidder with instructions to make payments within the established deadlines.
If the bid does not reach the minimum or reserve price, the award must be approved by the Insolvency Administration.
Warning: the Insolvency Administration reserves the possibility of communicating the winning bid to the Court for approval. In that case, only once the bid has been approved by the Court will the award confirmation be sent to the best bidder with instructions to make payments within the established deadlines.
