By submitting the bid, the bidder declares to have fully reviewed and to fully accept these conditions of sale and all documentation made available. If a sale notice is attached to the auction sheet/listing, by submitting the bid, the bidder declares to have reviewed and to accept the conditions stated therein, with respect to which these conditions of sale are to be understood as an extract. The bidder further declares to have examined and accepted all documentation made available for the purposes of participation

Deposit

The auction is subject to a security deposit of EUR 50,00.

The deposit must be mandatorily credited before the auction end.
Once the deposit has been credited, the user will be enabled to participate in the auction.
To speed up participation in the auction, the user  is advised to send a scanned accounting copy of the payment made with the CRO code to: [email protected]

If auction participants do not win any item, the deposit will be returned within 20 working days from the final auction end, without interest.

If, in the event of a winning bid, after paying the deposit, the bidder does not complete the purchase, such deposit will be retained.

Awarding of Lots

At the end of the auction, for the best offers received below the reserve price, the award will be subject to approval by the procedure bodies. 

Availability of Lots

Any registrations relating to pre-emption rights, transcriptions of foreclosures and preventive seizures and any other encumbrance burdening the goods put up for sale shall be cancelled pursuant to art. 217, paragraph 2 C.C.I.I. once the sale has been executed and the price fully collected. Any formalities for cancellation shall be carried out by and at the expense of the successful bidder.

All costs relating to transfers of ownership, including any double transfers and related charges, shall be borne by the successful bidder

In the event of export of registered movable assets, the purchaser must carry out the required operations in compliance with applicable regulations. Please note that for the purposes of deregistration for export, at the date of the request, the vehicles must be in compliance with the inspection obligations established by law.

Payment method

All payments must be made exclusively by bank transfer. The details will be specified either at the time of registration or upon the user's receipt of the award communication (see general conditions).

Payment deadline

The awarded lots must be paid within 5 days from the confirmation of provisional award.
The Buyer's Premium and ancillary management charges, where applicable, must be paid within 5 days from the confirmation of provisional award.

Collection of awarded lots
 
The collection of awarded lots by the purchaser may take place only after actual receipt of payment of the award price and the applicable commissions (Buyer's Premium, ancillary management charges).
 
In any case, collection must be completed no later than 30 days from the provisional award.
 
In order to optimize the collection service, GOBID INTERNATIONAL AUCTION GROUP SRL will notify the successful bidders by e-mail of the date(s) and a time during which they may proceed with collection of the lots. Such dates may also be indicated on the auction web page. GOBID INTERNATIONAL AUCTION GROUP SRL reserves the right in any case to modify the collection dates and times indicated at its sole discretion.
 
If the successful bidder collects on dates other than those communicated, they must pay a fee of between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of goods to be collected, as additional fees.
 
Successful bidders shall be required to comply with the start date of operations. If the successful bidder cannot collect on the communicated day and time, they may:
 
- subject to approval, request to be admitted during the date(s) scheduled for the next sale attempt, if any.
 
- subject to approval, collect on days and times other than those made available for the individual sale attempt, paying an additional fee of between EUR 250.00 and EUR 350.00 plus VAT per day, depending on the quantity of goods to be collected, as additional fees
 
Failure to comply with the scheduled collection date between GOBID INTERNATIONAL AUCTION GROUP SRL and the successful bidder will result in the application to the latter of a penalty of EUR 350.00 if the failure to collect is not notified at least 48 hours before the appointment, without prejudice in any case to compensation for any greater damage suffered by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
All lots not collected by the deadline indicated above shall be subject to a daily late fee of EUR 50.00. In the event that the goods are not collected within 30 days from the collection deadline, the sale shall be deemed automatically terminated and the amounts paid by the successful bidder (Awarded Lots - Buyer's Premium, ancillary management charges and any additional fees paid) shall be retained as a compensatory penalty.
 
GOBID INTERNATIONAL AUCTION GROUP SRL is not required to deliver any lot nor to organize in any way their collection.
 
The collection operations must be carried out by the purchaser in compliance with the applicable safety regulations established by law; the purchaser shall therefore be required to make the necessary adjustments in this regard also with reference to any third parties and/or collaborators employed in carrying out the aforementioned operations.
 
The purchaser is responsible for any dismantling, handling, loading and transport of the awarded lots and is required to leave the places involved in the collection in safe conditions and free from goods and/or waste materials produced by them during the aforementioned operations. In the case of registered movable assets, the purchaser shall be deemed responsible for handling the paperwork required to carry out the necessary transfers of ownership.
 
The transfers of ownership must therefore be carried out by and at the expense of the successful bidder at the vehicle registration agency communicated by the Procedure Bodies, or alternatively, communicated by GOBID INTERNATIONAL AUCTION GROUP SRL.
 
In the event of export of registered movable assets, the purchaser must carry out the required operations in compliance with applicable regulations.
 
In any case, GOBID INTERNATIONAL AUCTION GROUP SRL will not make any lot available before the aforementioned payments have been credited and, in the case of registered movable assets, before completion of the relevant transfer of ownership.
Other specific conditions

Buyer's Premium: A charge of 15,00% + VAT will be added to the hammer price of each lot.

The Buyer’s Premium will have a minimum amount of 25 € (+ VAT at 22% where applicable), on each lot or combination awarded, as minimum fees.

Additional management charges: They are ancillary costs borne entirely by the successful bidder, intended to cover the services and activities, performed and to be performed, necessary for the preparation, organisation and management of the sale of the goods at auction and the subsequent award phase. Such expenses must be paid at the same time as the payment of the buyer's premium due, as per the provisional award confirmation that will be issued after the end of the auction. Where due, such charges will be indicated in the sheet for each lot.

VAT: VAT at 22,00% of the sale price will be calculated on the hammer price of each lot. (where applicable)

Extra-Time: if a winning bid is placed in the 5 minutes before the auction closes, the time available to place another bid will be extended by a further 5 minutes from the last bid received. And so on, for each winning bid received within the 5 minutes of extra time, the time available to place another bid will be extended by a further 5 minutes from the last bid received.  Automatic bids in the event of a maximum bid (proxy bid) will also be considered  winning bids.

The lots are sold as seen and approved in the condition in which they are found. Viewing is recommended.


The sale of the goods is deemed forced (Art. 2919 c.c.) and is arranged for the goods as seen and approved in the factual and legal state in which they are found. In a forced sale, no warranty for defects in the item applies. It cannot be challenged on grounds of damage. (Art. 2922 c.c.).

Consequently, the existence of any defects or lack of quality or non-conformity of the item sold cannot give rise to compensation, indemnity or price reduction.

Any liability on the part of the Agent is excluded with regard to the existence of third-party rights over the goods subject to the sale (Art. 2920 c.c.).

The sale takes place with the obligation on and at the expense of the successful bidder to verify their compliance with safety regulations.

In the event of any disputes arising relating to the interpretation of the provisions contained in the general and specific conditions set out on the platform, possibly translated into other languages, the Italian version of the text shall prevail.
