GENERAL TERMS AND CONDITIONS
GOBID INTERNATIONAL AUCTION GROUP SRL is not responsible for missing or partial correspondence of the descriptions of lots in the auction. For each auction, specific Conditions will be published detailing all information relating to the auction itself and the lots.
Furthermore, for all matters not provided for in these general conditions, the provisions contained in the Terms of Use of the website www.gobid.it shall apply.
For all matters not expressly provided for in these general and specific conditions, reference is made to the provisions of the Italian Code of Civil Procedure and the Bankruptcy Law
Lots are sold as seen and liked in the condition in which they are.
Viewing the lots in the auction is strongly recommended, GOBID INTERNATIONAL AUCTION GROUP SRL and the seller decline all responsibility for any errors, omissions and inaccuracies in photos, descriptions, quantities and any other detail indicated in the lot catalogs; for this reason viewing the lots is strongly recommended in order to verify the actual condition of the goods in the auction.
Any adaptation of the goods to all applicable regulations and in particular to prevention and safety regulations as well as those concerning ecological and environmental protection and – more generally – to applicable regulations shall be the exclusive responsibility of the buyer, who shall bear any expense, with the seller being released from any liability in this regard. Any instrumental goods not complying with regulations currently in force, where included in the inventory, will be considered subject to sale solely as goods "to be scrapped", excluding any liability of the Trustee in bankruptcy for the use thereof by the assignee. In particular, for any goods not compliant with safety regulations, without CE marking, the successful bidder is obliged to proceed, at their exclusive care, expense and risk, to bring them into compliance or, if this is not possible, to dispose of them in the forms provided by law.
No warranty is given by GOBID INTERNATIONAL AUCTION GROUP SRL or the seller.
The registered user who is the successful bidder of one or more lots is required to comply with the conditions set out in the sale notice where the terms for payment and collection and the relevant compensation clauses in the event of failure to comply with the above conditions will be specified.
Collection operations must be carried out in compliance with the safety rules established by law, under the responsibility of the buyer/successful bidder, who must take action in this regard, also with reference to any third parties and/or collaborators employed in the aforementioned operations.
Gobid International Auction Group Srl declines all liability in this regard, as mere executor of an assignment aimed at the sale of the goods in the auction.
Any damage found following collection of the awarded lots will be entirely borne by the buyer.
In the case of export, in compliance with Italian law, Gobid International Auction Group Srl reserves the right to request payment of the VAT due on the awarded lots in order to avoid penalties for failure to pay VAT. The amount will be withheld until export has taken place and returned, where provided, upon presentation of the relevant documents.
The user authorized to participate in the auction is aware of possible objective and subjective issues arising from the use of an online auction for which GOBID INTERNATIONAL AUCTION GROUP SRL cannot be held liable
By accepting these conditions, the user releases GOBID INTERNATIONAL AUCTION GROUP SRL and the seller from any warranty or third-party claim.
GOBID INTERNATIONAL AUCTION GROUP SRL is not liable for direct and/or indirect damages and liabilities except in cases of willful misconduct or gross negligence.
Absolutely GOBID INTERNATIONAL AUCTION GROUP SRL is not liable for: direct actions of the user that may cause damage or malfunction to the system, unavailability of display and/or use of www.gobid.it, unlawful use of www.gobid.it.
GOBID INTERNATIONAL AUCTION GROUP SRL may not, under any circumstances, be held liable for any system malfunctions that may in any way impair or delay the delivery of communications to the person who registers.
The sale may, at the discretion of GOBID INTERNATIONAL AUCTION GROUP SRL, in agreement with the Bodies of the Procedure, be suspended and/or postponed either due to technical problems connecting to the system depending on server or network malfunctions, or at its unquestionable judgment for other reasons.
The recordings present in the log file generated by the system constitute full and exclusive evidence among all parties to this procedure, regarding the content and timing of documents/messages exchanged electronically. The persons who register declare and acknowledge that the system recordings constitute full evidence of the relationships between them. Such recordings are confidential and will not be disclosed to third parties, except in the cases expressly provided for or by order of the Judicial Authority.
For all matters not provided for in these conditions, the provisions contained in the terms of use of the website www.gobid.it shall apply.
In the event of any disputes arising relating to the interpretation of the provisions contained in the general and specific conditions shown on the platform, possibly translated into other languages, the Italian version of the text shall prevail.
