Deposit

To participate in the Auction, a specific deposit must be paid for each lot.

Lot 0 requires a deposit of EUR 16.000,00.

The deposit must be made by bank transfer to the account stated below:

The deposit must be paid before the end of the Auction.

Only once the deposit has been received will the user be authorized to participate in the Auction.
To expedite participation in the auction, it is recommended to send the proof of payment to [email protected].

Users who have participated in the Auction but have not been awarded any asset will receive their deposit back within 20 business days from the conclusion of the auction, without interest.

If participants are awarded one or more lots, the deposit paid will be refunded once the removal of all purchased lots has been completed, with prior authorization from the AC, within a maximum of 5 business days from the end.

If, after making the deposit and being awarded the lot for sale, the bidder does not complete the acquisition by paying the sale price and the Buyer's Premium, such deposit will be retained.

Charges

The sale of the assets is made free of charges and encumbrances.

However, all taxes, duties, and levies legally applicable relating to the award, sale, or transfer of each asset shall be borne by the awardees or buyers. If the vehicles have outstanding municipal IVTM taxes, these shall be borne by the awardee.

Award of the lots

At the end of the auction, if the winning bid is equal to or higher than the reserve price, an award confirmation will be sent to the highest bidder with instructions for making payments within the established deadlines.

If the bid does not reach the minimum or reserve price, the award must be approved by the Insolvency Administration.

Warning: the Insolvency Administration reserves the right to communicate the winning bid to the Court for approval. In this case, only once the bid has been approved by the Court will an award confirmation be sent to the highest bidder with instructions for making payments within the established deadlines.

Payment method

All payments must be made entirely by bank transfer using the accounts communicated at the time of registration or together with the award communication (see general auction conditions).

Payment deadline

Payment of the award price for the lots must be made within 10 days from the award communication.

Payment of the Buyer's Premium must be made within 5 days from the award communication.

Conditions for removal

In any case, removal must be completed no later than 20 days from the confirmation of provisional award.

In order to optimize the removal service, GOBID ESPAÑA S.L will notify the awardees by email of the date and time to proceed with the removal of the lots. These dates may also be indicated on the auction website. In any case, GOBID ESPAÑA S.L reserves the right to change the dates and times indicated for collection at its sole discretion.

If the awardee has to carry out removal on dates additional to those offered, they must pay an amount between EUR 250.00 and EUR 350.00 plus VAT for each added day, depending on the assets to be removed, as additional expenses.

Awardees must respect the proposed date. If they cannot carry out removal on the communicated date and time, they may:

- with prior approval, request that removal be allowed during the next scheduled session, if planned.

- with prior approval, carry out removal on days and at times different from those initially proposed in the same sale phase, paying a further fee of between EUR 250.00 and EUR 350.00 plus VAT per added day and person required for assistance, as additional expenses.

Failure to comply with the removal date scheduled between GOBID ESPAÑA S.L and the awardee will result in the application of a penalty to the latter of EUR 350.00 if they have not notified cancellation of the removal at least 48 hours before the appointment, without prejudice to the fact that, in any case, compensation for damages to GOBID ESPAÑA S.L must be paid.

Lots not removed within the established deadline will be subject to a daily penalty of EUR 100.00. If the asset is not removed within 15 days following the last day scheduled for removal, the sale shall be considered terminated and the amounts paid by the awardee (awarded lots – Buyer's Premium, supplementary management costs, and any additional charges paid) shall be retained as compensation for the damage caused.

GOBID ESPAÑA S.L is not obliged to deliver any lot or to organize in any way their removal and delivery.

Removal operations must be carried out by the buyer in compliance with the safety regulations in force established by law; therefore, they will be obliged to make the necessary arrangements even when referring to third parties and/or collaborators employed in carrying out the aforementioned operations.

The awardee is responsible for any dismantling, moving, loading, and transport of the awarded lots and, in the case of vehicles, also for the transfer of ownership and other corresponding formalities.

In any case, GOBID ESPAÑA S.L will not make any lot available before the above payments have been paid and, in the case of registered movable assets, before the corresponding transfer of ownership has been completed.

Formalization and removal of the assets:

The successful bidder will be obliged to formalize the corresponding sale and purchase contract within the period indicated by the auction management entity. Likewise, it must carry out, at its own expense and responsibility, all necessary formalities for the transfer of ownership of the awarded asset before the Directorate-General for Traffic (DGT) and any other applicable public registries.

In the event that the removal of the asset takes place prior to the transfer of ownership, the successful bidder shall assume from that moment all responsibilities, charges, expenses, taxes and penalties that may arise from it, expressly releasing the selling entity and the management entity from any liability after delivery.

Other specific conditions

Buyer’s Premium: a charge of 18,00% (plus 21% VAT, if applicable) of the award price of each lot, which will be added to it.

The Buyer’s Premium will have a minimum amount of 50 euros (plus 21.00% VAT, if applicable) for each awarded lot or combination (minimum commission).

Administration costs: These are additional costs borne entirely by the successful bidder, intended to cover the services and activities, carried out and to be carried out, necessary for the preparation, organization and management of the sale of the assets at auction and the post-award phase. These costs must be paid together with the payment of the buyer's premium (buyer's fees) according to the provisional award confirmation that will be issued once the auction has ended. If applicable, such costs will be indicated in the file for each lot. In the event of the award of several lots, a reduction of such costs may be agreed based on the actual days for removal and the service offered by Gobid.

Formatting of Computer Equipment: The successful bidder of the computer equipment lot must format the equipment that requires it before removal. The cost of formatting will be borne by the successful bidder, who must also certify that the equipment has been wiped in accordance with current regulations.

Decontamination of equipment/elements: If any of the elements requires decontamination before removal, the decontamination process, as well as any other procedure necessary for its proper securing, dismantling, removal and transport, in accordance with current regulations, will be the responsibility of the successful bidder, including the associated costs.

Award Taxes: 21.00% VAT, which will be calculated on the award amount of each lot (if applicable).

Bids on the Complete Lot: In the event that no bids are received for the complete lot (Lot 0), the individual lots will be awarded, provided that bids have been received, in accordance with the provisions of the "Award of lots" paragraph. In the event that bids are received both for the Complete Lot (Lot 0) and for the individual lots, the Insolvency Administration, at the end of the auction, will have to decide whether to award the Complete Lot or the individual lots, based on the values reached, at its unquestionable judgment.

Extra-Time: If any user places a bid in the last 5 minutes, the deadline will be extended by an additional 5-minute period and the countdown will start again, and so on until no offer is made in the last 5 minutes of extra-time. In the case of a maximum bid (proxy bid), automatic increments will be considered valid for the extension of the extra-time period.

The sale of the assets will be carried out in accordance with their current situation, both as regards their physical configuration and their legal status. It is advisable to visit the lots for sale.

All expenses caused by the disposal will be for the account of the successful bidder, including removal and transport costs, any costs for the transfer of ownership, notarial deed and any cancellation in any public registry of the charges or encumbrances established on them. At no time are either the Principal or GOBID ESPAÑA SL responsible for the proper functioning, condition, MOT inspections, etc. of the lots that make up the asset. For this purpose, their transfer will be made as a specific entirety.

In the sale, no type of post-sale warranty applies for non-conformity of the asset, so that it cannot be claimed by any of the purchasers or interested parties.

Therefore, the existence of any damage or lack of quality in the sold assets may not give rise to any out-of-court or judicial action for compensation or redress.

The buyer assumes at its own risk the condition in which the vehicles are found, and may at no time exercise any claim on any grounds, including defects or faults, taking into account that they were collected from the street.

Any liability of the Agent relating to the existence of third-party rights over the assets subject to the sale is excluded.

The sale is carried out with the buyer's obligation to assume its own costs and responsibility in order to verify its true conformity with the asset offered for sale.

The physical and legal condition of the assets subject to auction shall be expressly accepted by the bidders from the moment of their participation in the public sale process and without warranties, and the price may not be revised nor may the sale be withdrawn for any circumstance, the bids made being irrevocable

All costs of the public sale and those arising from the cancellation of charges and registry annotations, both from attachments and arising from the insolvency proceedings, will be for the account and charge of the purchasing party.

All costs for dismantling and moving the assets, as well as any repairs necessary for their delivery to the successful bidder, will also be for the account of the purchasing party.

In the event that, at any of the stages provided for the auction of the assets, the highest bidder designated as the successful bidder does not appear to execute the public or private documents necessary for their transfer and payment of the auction price, the debtor, regardless of its right to demand the corresponding liabilities for breach by the aforementioned highest bidder, without the need for express judicial declaration or summons, may consider the bid withdrawn, declaring as successful bidder the subsequent highest bidders in the public auction held, in the order of their respective bids.

If a deposit had been required to participate in the public auction, when the highest bidder is considered to have withdrawn pursuant to the preceding paragraph, it shall be deemed awarded to it as compensation for damages for the insolvency proceedings, with its amount applied among the creditors in accordance with law.

Any liability of GOBID ESPAÑA SL arising from errors or inaccuracies in the translation of the texts and material published on the website is excluded.
